Section D-8. Void assessments and refunds

(a)§

Void

The Clerk must void an unpaid assessment when:

1.§

the associated case or filing is rejected and the ECMS provides for voiding;

2.§

the assessment is an exact duplicate;

3.§

no positive amount was lawfully adopted;

4.§

the filing or role was miscoded by Court staff;

5.§

the fee resulted solely from verified ECMS malfunction; or

6.§

law otherwise requires.

(b)§

Refund

The Clerk must refund a paid amount when it was:

1.§

collected without an adopted lawful amount;

2.§

collected twice;

3.§

calculated from an incorrect Court-assigned code;

4.§

collected after waiver or exemption; or

5.§

required to be returned by law or Court order.

Withdrawal, settlement, or voluntary dismissal does not alone require refund after the service was rendered. A denial must state reasons and identify review by motion under Rule 6(f).
