Rule 29. Clerk review; rejection; corrected, amended, and withdrawn filings
Whole-filing review
The Clerk reviews a filing as one unit and may Accept or Reject it. The ECMS does not permit partial acceptance. Acceptance requires every document to have been uploaded and the case to be Active.
Grounds for rejection
The Clerk may reject a filing only for a clear, material defect, including:
lack of authority to file;
an unusable, malicious, corrupted, password-locked, or prohibited file;
absence of a required document that makes the submission unintelligible;
filing in a workflow or court that cannot lawfully receive it;
a violation creating a substantial privacy or security risk;
an incurable failure to satisfy a Court order;
another ground expressly stated in these Rules; or
Rule 6(b) governs timely jurisdiction-invoking documents.
Reason and review
A rejection must state a reason of no more than 500 characters and identify the responsible Clerk and time. The filer receives notice and may seek review under Rule 6(f).
Corrected filing
A correction is a new filing titled Corrected [Document Title]. It must:
identify the original Bates number;
describe each material correction;
contain the complete corrected document; and
use the closest available filing code.
The original remains in the immutable record. Unless the Court orders otherwise for legal purposes, the corrected filing bears its own later filing date.
Amended filing
When amendment is allowed by law or order, the amended filing must be complete, titled Amended [Document Title], and identify the filing superseded. Amendment changes the filing’s legal effect but does not delete or replace original bytes. Civil appellate proceedings may be amended in furtherance of justice under 7 R. Stat. § 132.403.
Withdrawal
Because the ECMS has no withdrawal status, a filer withdraws a document by filing a Notice of Withdrawal or obtaining an order. The withdrawn document remains preserved and accessible according to its original status but has no further operative effect to the extent permitted by law.
No reversal of acceptance
The ordinary review route cannot reverse Accepted status. If late-arriving bytes cause automatic demotion from Accepted to Submitted, the Clerk must review the complete filing again and notify participants.
