Rule 26. Opening a matter; docket, case number, and caption

(a)§

Ordinary Supreme case types

An ordinary initiating filing must use the case type matching its legal character:

1.§

APPEAL for an appeal as of right;

2.§

PETITION_FOR_REVIEW for discretionary review or certiorari;

3.§

WRIT for an extraordinary writ in aid of appellate jurisdiction;

4.§

ORIGINAL_ACTION only for jurisdiction expressly supplied by law; or

5.§

another case type specifically authorized by a Court technical standard.

(b)§

Originating case

For an Appeal, Writ, Petition for Review, or ordinary Original Action, the portal requires an existing originating Superior-tier case number. The filer must provide the genuine electronic number of the matter under review. For an Administrative Court matter represented in the Superior tier, use its associated electronic number. If none exists, contact the Clerk; do not fabricate one.

Docket creation

The ECMS creates an Active case and docket when the initiating transaction commits. Docketing is automatic and occurs before Clerk acceptance of the initiating filing. The Clerk must not describe acceptance as the act that first created the case.

(d)§

Case number

An ordinary new Supreme matter receives an RSPC-... case number. Legacy matters may retain a YY-NN number. A generated number is not sequential, does not prove filing order, and does not encode the filing year unless its literal format so states.

(e)§

Caption

Unless law or Court order requires another form:

1.§

an appeal is captioned [Appellant] v. [Appellee];

2.§

discretionary review is captioned [Petitioner] v. [Respondent];

3.§

a personal extraordinary writ is captioned In re [Petitioner];

4.§

a certified question retains the originating caption followed by On a Certified Question;

5.§

attorney discipline is captioned In re [Attorney];

6.§

judicial discipline is captioned In re [Judicial Officer]; and

7.§

impeachment is captioned In re Impeachment of [Officer].

The Clerk may correct a caption without changing party rights.

(f)§

Related matters

The initiating filer must identify every related Ridgeway proceeding, docket number, tribunal, current status, and disposition. The Clerk must cross-reference related cases without merging their records.
