Rule 11. The Chief Justice and succession

(a)§

Administrative authority

The Chief Justice:

1.§

presides at Court sessions and conferences;

2.§

supervises the Court’s administrative work;

3.§

assigns opinions when in the majority, or follows Rule 71 when not;

4.§

designates the Duty Justice and visiting assignments authorized by law;

5.§

summons the Judicial Conference as required; and

6.§

performs duties assigned by the Constitution, statute, or these Rules.

(b)§

Adjudicative equality

The Chief Justice has one vote and may not decide for the Court without the participation required by Rule 10.

(c)§

Succession

If the Chief Justice is unable to act or the office is vacant, the powers and duties of the office devolve on the Associate Justice next in lawful precedence who is able and not disqualified to act. The acting service ends when the Chief Justice resumes duties or the vacancy is filled.

(d)§

Case-specific inability

If the Chief Justice is disqualified only from a particular matter, the senior participating Associate Justice performs the presiding duties in that matter.
