PROBABLE CAUSE STATEMENT
October 12, 2026 State of Ridgeway v. COMMANDERIZP
DATE WRITTEN IN SUPPORT OF THE ABOVE-REFERENCED CASE
I, AngellicTerror, hereby depose and state as follows:
I. INTRODUCTION AND OFFICER BACKGROUND
1. Your affiant is a Sergeant within the Ridgeway National Guard (“RNG”) and is assigned
to the 164th Military Police Battalion, 91st Military Police Investigations Company
(“MPI”). As a result of my employment, I am an officer of the State of Ridgeway who is
empowered by law to conduct investigations and make arrests for offenses enumerated in
Titles One through Six of the Ridgeway County Criminal Code, and, when authorized
and necessary, utilize issued less-lethal force options in the performance of my official
duties. In addition, as a result of my employment, I have received specialized training
regarding the lawful use of force, including the deployment of conducted electrical
weapons (tasers), the circumstances under which such force may be used, and the legal
limitations governing their use.
2. This affidavit is being submitted in support of a criminal complaint alleging that
Commanderizp violated the following state criminal laws:
3 R.C.C. §08(a) Aggravated Battery II on 1 count; AND,
2 R.C.C. § 15 Official Misconduct on 1 count.
146-1002-MPI-RNG ~ 2 ~ 10/07/2026
engaging in fighting; or taunts another under
circumstances in which that conduct is likely to provoke a
violent response; or intentionally hinders the movement
of a person on public or private property; or creates any
condition which presents a risk of physical harm to
persons or property.
3. This affidavit is based on my personal knowledge, information provided to me by
personal testimony from the victim, my training and experience, as well as the training
and experience of other law enforcement agents.
4. Because this affidavit is being submitted for the limited purpose of establishing probable
cause in support of a criminal complaint, I have not included every fact known to me
concerning this investigation. I have only set forth the facts that I believe are necessary to
establish probable cause that the defendant violated the state criminal laws set forth
herein.
II. SUMMARY OF OFFENSE CONDUCT.
5. On October 3rd, 2026, a misconduct tipline submission was created and submitted to the
91st Military Police Investigations Company ("MPI") of the Ridgeway National Guard
("RNG"), alleging that COMMANDERIZP ("COMMANDER") violated while acting as
a guardsman. The attached video evidence (Exhibit A) clip shows Sergeant First Class
Patothe1st ("PATO" or “complainant”) on duty at the Palmer Car Dealership in RNG
Operational Camouflage Pattern. COMMANDER approached PATO from behind and
discharged his TB26 taser, repeatedly clicking to incapacitate PATO for over twenty
seconds. At the time of the incident, PATO posed no threat to either members of the
public or COMMANDER himself, as he did not equip a firearm or perform any hostile
action, rendering COMMANDER's use of force unreasonable.
6. Statements from witnesses were obtained during the investigation, including the
complainant interview with PATO (Exhibit B), witness interviews with sherriffAces_ALT,
Chewalicious, Sibli57, Draco123ASAP, and Cubby_Chee (Exhibits C-G), as well as the
accused interview with COMMANDER (Exhibit H). Video evidence and sworn witness
testimony consistently demonstrate that PATO posed no threat before being tased,
confirming there was no lawful justification for the deployment of force.
146-1002-MPI-RNG ~ 3 ~ 10/07/2026
7. COMMANDER was contacted regarding this incident and was offered to provide a
voluntary statement (Exhibit H). During this interview, COMMANDER initially claimed
to have proper knowledge and understanding of use of the TB26 Taser. However, further
questioning revealed he did not receive any training or certification on the TB26 taser
during his employment within the Special Forces Detachment or the National Guard, and
as such could not have received proper knowledge and understanding of its use.
8. Upon review of the State’s database, RNG’s OPREGs, and other relevant documents, it is
your affiant’s professional determination that no law, policy, or regulation authorized the
discharge of the TB26 Taser under the circumstances depicted in Exhibit A. Throughout
the incident, PATO did not draw a firearm or any other object capable of causing bodily
harm, nor did he make any threatening statements or gestures that would cause a
reasonable person to fear imminent bodily injury. As such, the facts known to your affiant
demonstrate that PATO did not pose a threat that would justify the use of a conducted
energy device.
9. Furthermore, the footage shows that COMMANDER intentionally taser-locked PATO
and continued to keep him immobilized for an extended period of time. Based on these
actions, your affiant, as a trained and experienced law enforcement officer and criminal
investigator, can reasonably conclude that COMMANDER’s conduct was directed
specifically at PATO and was not accidental, careless, reckless, or intended for any other
target. The deliberate deployment and continued application of the TB26 Taser against
PATO demonstrates that COMMANDER acted intentionally when committing the
offensive physical contact, rather than through mistake or negligence.
10. Furthermore, COMMANDER is a public servant employed by the Ridgeway National
Guard, and at the time of the incident COMMANDER was on duty as a guardsman of the
Ridgeway National Guard, as evidenced by the color of his nametag in Exhibit A. As a
member of the Ridgeway National Guard, COMMANDER is entrusted with specific
powers and responsibilities arising from his public office. By committing a crime against
the State while acting in his official capacity, COMMANDER engaged in conduct
146-1002-MPI-RNG ~ 4 ~ 10/07/2026
relating to his office that constituted an unauthorized exercise of his official functions,
knowing such conduct was not authorized by law. By engaging in criminal
conduct inconsistent with the lawful execution of his duties, COMMANDER failed to
perform duties clearly inherent in the nature of his office as a public servant.
III. APPENDIX OF EVIDENCE
11.
IV. CONCLUSIONS AS TO PROBABLE CAUSE FOR A CRIMINAL COMPLAINT
Based on the above facts and circumstances, it is your affiant’s belief that probable cause exists to
warrant a Criminal Complaint to be filed against COMMANDERIZP in violation of:
3 R.C.C. §08(a) Aggravated Battery II on 1 count; AND,
2 R.C.C. § 15 Official Misconduct on 1 count.
