STATE OF RIDGEWAY
SUPERIOR COURT FOR RIDGEWAY COUNTY
STATE OF RIDGEWAY,
-v-
AXCFTP,
Defendant.
Case No. RSC-CM-3202
MEMORANDUM IN AID OF
SENTENCING
Presiding Judge: Hon. Detachment_Result
COMES NOW, the State of Ridgeway, by and through its counsel, pursuant to Rid. R.
Crim. P. 28.1 to address the sentencing factors of 18 U.S.C. § 3553(a) pertinent to the
defendant’s sentencing and to request that this Honorable Court impose a sentence of
incarceration within the Ridgeway Department of Corrections to include: a term of sixty (60)
minutes for Count One - Official Misconduct, and a term of fifteen (15) minutes for Count Two -
Involuntary Manslaughter; with terms to run consecutive to each other for a total term of
incarceration of seventy-five (75) minutes.
IMPOSITION OF SENTENCE
The Supreme Court of Ridgeway is, through Judicial Conference, vested the authority to
establish sentencing guidelines for the State of Ridgeway through 6 R. Stat. § 131.309. As such
guidelines have not been established, the State has adopted 18 U.S.C. § 3553(a) as the sentencing
guidelines for the purposes of this memorandum and will address the sentencing factors
contained therein. This court must impose a sentence that is “... sufficient but not greater than
necessary, to comply with the purposes [of sentencing] set forth in section 2 of 18 U.S.C. §
3553(a).”
In determining the sentence to be imposed, this court must consider the §3553(a) factors.
Those are:
A. The Nature and Circumstances of the Offense
Defendant axcftp plead guilty to Official Misconduct, a felony, in violation of R.C.C. §
2.15 and Involuntary Manslaughter, a misdemeanor, in violation of R.C.C. § 3.05. The
defendant, a certified and sworn law enforcement officer in and for the State of Ridgeway duly
employed in the Ridgeway County Sheriff’s Office (hereinafter “RCSO”), received training
through the Ridgeway Law Enforcement Training Center on proper custody and control
techniques and on identification of violations of the Ridgeway Criminal Code. As a deputy of the
Ridgeway County Sheriff, lawfully bound duties of the defendant include enforcement of the

laws of the state as prescribed by 9 R. Stat. § 331.202(a), and to arrest offenders against the
criminals laws wherever they may be found within the state as prescribed by 9 R. Stat. §
331.202(h). Further, as an employee of the Ridgeway County Sheriff’s Office, the defendant is
bound by the RCSO Department Handbook. Section 504 of the RCSO Department Handbook
mandates deputies to take appropriate action when witnessing the commission of a crime and
follow all department policies and state laws while conducting arrests.
While on duty, the defendant observed a civilian, DeadAKM, to be in the possession of a
Stetson M2-A assault rifle. Pursuant to 9 R. Stat. § 412.102 and R.C.C. § 2.29, Stetson M2-A
assault rifles cannot be purchased and/or otherwise possessed lawfully by civilians. The
defendant detained DeadAKM for this offense, however, shortly thereafter released him without
effecting an arrest or seizing the Stetson M2-A assault rifle. After being released from the
temporary detention, DeadAKM promptly shot and killed a nearby civilian bystander, lolboy133.
The defendant knowingly had a legal obligation to apprehend and effect an arrest upon
DeadAKM, and to seize the unlawful Stetson M2-A. The defendant willfully released
DeadAKM, who proceeded to intentionally kill lolboy133, a killing which would have been
prevented if the defendant had adhered to his legal obligation and duty to arrest DeadAKM.
In killing lolboy133, DeadAKM, committed Murder in the Second Degree, a felony, in
violation of R.C.C. § 3.02. The defendant, axcftp, failed to take appropriate action as required by
law when observing DeadAKM to unlawfully possess a firearm by releasing him instead of
arresting him and/or seizing the illegal firearm. By failing to do so, axcftp failed to prevent
DeadAKM’s completely avoidable commission of murder in the second degree while having a
legal duty to make a proper effort to do so. As such, axcftp is an accomplice to DeadAKM’s
second degree murder pursuant to 6 R. Stat. § 121.303(a)(3). The State filed involuntary
manslaughter against axcftp as a lesser-included offense to murder in the second degree by
accomplice.
B. History and Characteristics of the Defendant
At the time of the offenses alleged, the defendant, axcftp, was a Sergeant in the
Ridgeway County Sheriff’s Office assigned as the Special Response Deputy Commander. The
defendant was hired on 03/20/2026. The defendant was previously assigned as the head of public
relations and to the traffic unit. The defendant resigned on 10/11/2026, approved by UnitedGPT.
The defendant does not have any criminal history, nor does he have any prior expungement
proceedings filed with the Superior Court.
C. The Need for the Sentence imposed -
a. To Reflect the Seriousness of the Offense, Promote Respect for the
Law and to Provide Just Punishment for the Offense.
The offenses axcftp plead guilty to, Official Misconduct and Involuntary Manslaughter,
are a felony and a misdemeanor, respectively. Consecutive terms of incarceration with the

Department of Corrections of sixty (60) minutes and fifteen (15) minutes will reflect the
seriousness of the offenses, promote respect for the law, and provide just punishment.
b. To afford Adequate Deterrence to Criminal Conduct.
Law enforcement officers in the State of Ridgeway, by virtue of the legal duties and
responsibilities of their public offices, possess the power to seize a citizen’s liberty and property,
and in extreme circumstances, life. These powers must be exerted in good faith and in
accordance with the Constitution and laws of the State to ever ensure the legitimacy of our
State’s sovereignty. Those who enforce the laws of our State are also compelled to adhere to the
same laws, and must be held accountable in the same manner when they fail to adhere to such
civic responsibilities. The imposition of a sentence of incarceration in this matter will serve to
remind the law enforcement officers of the State that they shall also be held accountable for
unlawful acts and deter them from committing such.
c. To Protect the Public from Further Crimes of the Defendant.
This is axcftp’s first contact with the criminal justice system as a defendant. Based on his
absence of prior contacts with the criminal justice system, and his immediate acceptance of
responsibility and remorse for his conduct, the State believes it is likely that it will be his last. A
sentence of incarceration will ensure that he has no further criminal conduct, and will protect the
public from any further crimes by axcftp.
d. To Provide the Defendant with Needed Educational or Vocational
Training, Medical Care, or Other Correctional Treatment in the Most
Effective Manner.
The defendant, axcftp, is a well-established law enforcement officer and is not in need of
any educational or vocational training, nor does he require medical care or other corrective
treatment.
D. The Kind of Sentences Available, and
E. The Kinds of Sentence and the Sentencing Range Established By The
Guidelines
The Ridgeway Criminal Code states that Official Misconduct is punishable by a term of
incarceration of sixty (60) minutes, and that Involuntary Manslaughter is punishable by a term of
incarceration of fifteen (15) minutes. The Ridgeway Criminal Code does not provide for any
fines attributable to either offense. Probation, split-probation, community service, and restitution
are potentially viable alternative sentencing options, however the State argues against such as the
defendant has specifically requested to serve a term of incarceration; the State does not contest
the defendant’s wishes in this matter. The State does not move for any specific or particular
requirement of expungement eligibility as it pertains to 6 R. Stat. § 131.312.

F. The Need to Avoid Unwarranted Sentence Disparities Among Defendants
with Similar Records Who Have Been Found Guilty of Similar Conduct.
The State, through legal review of entered judgements in the Ridgeway Superior Court,
was unable to find a case with enough similarity to cite as an appropriate reference. The State
contends that the imposed sentence of incarceration is appropriate and does not establish any
disparity.
CONCLUSION
The State of Ridgeway, by and through its counsel, moves for the imposition of a
sentence of incarceration within the Ridgeway Department of Corrections for a term of sixty (60)
minutes for Count One - Official Misconduct, and a term of fifteen (15) minutes for Count Two -
Involuntary Manslaughter; with terms to run consecutive to each other for a total term of
incarceration of seventy-five (75) minutes. Such a sentence is consistent with the 18 U.S.C. §
3553(a) factors, the Ridgeway Criminal Code, and Rid. R. Crim. P. 28.1. The State contends that
while the defendant was a regarded member of Ridgeway’s law enforcement community and
appreciates his prior service to the community at-large, the actions alleged in the information
demand repercussion in order to preserve the peace and dignity of the State.
