DEFENDANT’S OMNIBUS MOTION TO STRIKE
NOW COMES the Defendant, by and through counsel, and hereby moves this Honorable Court
to strike every document filed in the record of this matter on behalf of the Plaintiff by attorney
Thr33six8, spanning from September 3, 2026, through the present date. In support of this
Motion, Defendant respectfully states as follows:
MEMORANDUM OF LAW
1. Procedural Background: On September 3, 2026, attorney thr33six8 was officially
suspended from the practice of law in the State of Ridgeway. Despite this binding
suspension, thr33six8 continued to transmit and submit various filings, pleadings, and
documentation into the Court's electronic filing system under the guise of representing
the Plaintiff.
2. Lack of Authority to Act: Under Rule 1.1(4) of the Ridgeway Rules of Civil Procedure,
an attorney who is not actively recorded or authorized on a case has absolutely no
authority to act for a party. Furthermore, Rule 11(2)(6) explicitly mandates that where an
attorney named in a notice of appearance is suspended or disbarred, any subsequent
notice or authority shall be refused. The continuous link between an attorney and a party
is legally severed by structural operation of law under Rule 11.1(6) upon the attorney’s
active suspension. Consequently, thr33six8lacked any and all legal standing or authority
to submit filings on behalf of the Plaintiff as of September 3, 2026.
3. Violation of Signing and Representation Rules: Pursuant to Rule 11(1)(1), every
pleading of a represented party must be signed by at least one attorney who is admitted to
practice in this State. By transmitting documents into the electronic filing system, an
account holder certifies compliance with the rules of admission and standing. Filing
documents while suspended constitutes a willful violation of Rule 11. Rule 11(1)(5)
explicitly provides that if a pleading is signed with the intent to defeat the purpose of the
rule, or if it lacks an authorized signature, it may be stricken by the court, and the action
may proceed as though the paper had never been filed.
4. The Court's Power to Strike: Rule 12(3) grants this Court explicit authority to order
stricken from any pleading or filing any insufficient defense, immaterial matter, or legally
defective submission. Because every paper transmitted by thr33six after September 3,
2026, was filed in direct violation of the rules of appearance, legal signature
requirements, and the attorney's active suspension status, all such documents are a legal
nullity and must be struck from the record.
PRAYER FOR RELIEF
WHEREFORE, Defendant respectfully requests that this Honorable Court enter an Order:
a) STRIKING each and every document, pleading, motion, and brief filed by attorney thr33six8
on behalf of the Plaintiff from September 3, 2026, through the date of this Order;
b) ORDERING that the case proceed as though these unauthorized documents had never been
filed; and
c) GRANTING any further relief this Court deems just and proper.
Dated: October 6, 2026
Respectfully submitted,
