IN THE SUPERIOR COURT OF RIDGEWAY
FOR RIDGEWAY COUNTY
THR33SIX8,
Plaintiff
v.
GALAXYDRO,
Defendant
Case No.: RSC-CV-6918
DEFENDANT'S ANSWER TO THE COMPLAINT
Defendant Galaxydro, who is sued in his official capacity as a Lieutenant of the Milton City Police
Department, answers the Complaint through his attorney. Each number below responds to the
paragraph of the Complaint with the same number. Anything not specifically admitted is denied.
Responses to the Allegations
1. Defendant admits that he is a Lieutenant with the Milton City Police Department, which is an
agency of the City of Milton. He admits that he has worked there since March 8, 2026, and has held
his peace officer certification since April 23, 2022. He denies that his timezone is UTC–07:00. He
is in the Eastern timezone.
2. Defendant does not have enough information to say whether this is true, so he denies it.
3. This paragraph is a legal argument about the Court's authority, so no response is needed. If one
is needed, Defendant does not currently dispute that this Court has jurisdiction over this case.
4. This paragraph is a legal argument about venue, so no response is needed. If one is needed,
Defendant does not currently dispute that venue is proper.
5. Defendant admits that an incident involving Plaintiff took place on September 28, 2026. He
does not have enough information to say where Plaintiff was, so he denies the rest of this
paragraph.
6. Defendant does not have enough information to say whether Plaintiff had an RFLID, so he
denies this paragraph.
7. Defendant admits that he shot and killed Plaintiff during an incident on September 28, 2026. He
denies the rest of this paragraph.
8. Defendant admits that he searched the trunk of Plaintiff's vehicle and saw boxes of .45 ACP. He
denies the rest of this paragraph.
9. Defendant admits that he took 5 boxes of .45 ACP from the vehicle. He denies the rest of this
paragraph, including the claim that he took them only temporarily.
10. The statute speaks for itself. Defendant admits that he searched Plaintiff's vehicle. He denies
that the search was unlawful, and he denies that there was no probable cause. He denies the rest of
this paragraph.
11. This paragraph is a legal conclusion, so no response is needed. If one is needed, Defendant
denies it.
12. Defendant denies this paragraph.
13. This paragraph is a legal conclusion, so no response is needed. If one is needed, Defendant
denies it.
About the Exhibit: Defendant says the exhibit speaks for itself. He does not have enough
information to say whether it is authentic or how it was made.
About the Prayer for Relief: Defendant denies that Plaintiff is entitled to any relief. He also points
out that Plaintiff asks for punitive damages from him in his individual capacity, but the Complaint
names him only in his official capacity.
Defenses
1. Failure to state a claim. The Complaint does not state a claim for which the Court can grant
relief. Rid. R. Civ. P. 12(1)(5). Among other reasons, Plaintiff asks for money from Defendant
personally, but sued him only in his official capacity.
2. Immunity. To the extent they apply, Defendant is protected by sovereign and governmental
immunity, including under 7 R. Stat. § 122.002. This defense can be raised at any time before
judgment. Rid. R. Civ. P. 12(8)(4).
3. Lawful authority. Any search or seizure was within Defendant's legal authority as a peace
officer, including under 9 R. Stat. § 361.301, because the vehicle was used in the incident.
4. Contraband. Defendant had probable cause to believe the ammunition was contraband.
5. Reservation. Defendant may amend this Answer and raise additional defenses as Rid. R. Civ. P.
16 allows.
Relief Requested
Defendant asks the Court to dismiss the Complaint with prejudice, enter judgment for him, and
grant any other relief the Court finds fair.
