Pursuant to Rid. Rule Civ. Proc. 37(2), Plaintiffr's undersigned counsel files this
application for default judgment. He has sworn under the penalty of Perjury, a conviction only
felony enforced with 20 minutes of imprisonment and/or a fine of RW$2,500, R.C.C. § 2.10, the
following:
SWORN STATEMENT

2. The sole defendant in this civil action, who is Defendant chexburger, is sued in his
official capacity as a deputy of the Ridgeway County Sheriff's Office. See Complaint in
throwmorethansix v. chexburger, No. RSC-CV-5735 (Rid. Super. Ct. 2026), ECF No.
BATES-20260927-1206541248, p. 1, ¶ 1.
3. Defendant and the other appropriate individuals have been served, see Proof of Service,
ECF No. BATES-20260927-6718939262.
4. As the record and the rules reflect, Defendant has had 4 days from service to file an
answer. He has not filed the answer.
5. As the record reflects, Defendant has appeared in the case channel. FURTHER
AFFIANT SAYETH NAUGHT.
