Pursuant to Rid. Rule Civ. Proc. 37(2), Petitioner's undersigned counsel files this
application for default judgment. He has sworn under the penalty of Perjury, a conviction only
felony enforced with 20 minutes of imprisonment and/or a fine of RW$2,500, R.C.C. § 2.10, the
following:
SWORN STATEMENT
1. My timezone is UTC–5:00, but I will use the UTC+0:00 timezone for any timestamps in
this affidavit.
2. The sole respondent in this civil action, who is Respondent chexburger, is sued in his
official capacity as a deputy of the Ridgeway County Sheriff's Office. See Petition in In
re throwmorethansix, No. RSC-CV-8128 (Rid. Super. Ct. 2026), ECF No.
BATES-20260927-3810078277, p. 1, ¶ 1.
3. Defendant has filed a notice of appearance, BATES-20260927-3810078277. The record
reflects no defense of insufficency of process, so he has therefore waived summons. Rid.
Rule Civ. Proc. 4(9)(3).
4. Respondent had 24 hours "from service" to file a return, which is the responsive pleading
in a petition for habeas corpus. Rid. Rule Civ. Proc. 56(3)(8). The record reflects that
none have been filed, and provided that "from service" becomes "upon appearance" for
this case, see, e.g., Ante, at ¶ 3, respondent has failed to plead.
5. As the record reflects, Respondent has appeared in the case channel. FURTHER
AFFIANT SAYETH NAUGHT.
