(Name and identification of law enforcement officer, investigator, or person having information as probable cause)
knowing that false statements on this form are punishable by law, state that the facts contained herein
are true. Your affiant has probable cause to believe that on 09/15/26, at the Ridgeway County Sheriff’s
Office in Ridgeway County, State of Ridgeway, defendant AXCFTP committed one or more criminal
offense(s):
CODE AND CHARGES COUNT(S)
RCC § 2.15 Official Misconduct

constitutes an unauthorized exercise of their official functions, knowing that such an
act is unauthorized; or refrains from performing a duty which is imposed upon them or
which is clearly inherent in the nature of their office.

2. As a result of my employment, I am a credentialed law enforcement officer of the State of
Ridgeway that is empowered by law to conduct criminal investigations and make arrests for
offenses codified in the State of Ridgeway Criminal Code. Additionally, within my employment with
an investigative branch of the Ridgeway State Police, I have received extensive training on
investigative tactics, criminal investigation, misconduct investigations, criminal law and other
topics in accordance with my employment.
3. This affidavit is being submitted in support of a criminal complaint alleging that AXCFTP violated
the aforementioned criminal statute.
4. This affidavit is based on my personal knowledge, information provided to me by other law
enforcement agents, my training and experience, as well as the training and experience of other
law enforcement agents.
5. Because this affidavit is being submitted for the limited purpose of establishing probable cause in
support of a criminal complaint, I have not included every fact known to me concerning this
investigation. I have only set forth the facts that I believe are necessary to establish probable
cause that the defendant violated the state criminal laws set forth herein.
6. All timestamps referenced in this Probable Cause statement are set in Eastern Daylight Time
(EDT).
7. On September 26th, 2026, I was assigned to a case by Ridgeway State Police investigation’s
command, involving officer misconduct of criminal nature. Attached with the complaint is video
footage (Exhibit A), depicting the incident of concern.
8. On September 15th, 2026 at approximately 4:42 AM, an anonymous complainant recorded video
footage from their own perspective (Exhibit A) depicting the defendant, AXCFTP, detaining a
subject in cuffs after the subject was openly displaying an Stetson M2-A, an illegal firearm whose
possession is criminalized by RCC § 2.29 Unlawful Possession of a Firearm as well as RCC § 2.26
Unlawful Possession of Government-Issued Equipment. The defendant, is then seen in the same
video clip, bringing the subject to the exterior doors of the Ridgeway County Sheriff’s Office
substation in Sterling, and then immediately coming back to the public area by the substation with
the subject in cuffs and releasing him from cuffs, with the illegal firearm still in his possession, as
evidenced through the rifle, a Stetson M2A, being visible on the subject’s back. The subject is then
seen in the same footage seconds later, opening fire on an innocent bystander, without any
credible provocation from the victim who was killed by the gunfire.

9. Per the State of Ridgeway Criminal Code (Exhibit B), RCC § 2.15 Official Misconduct, is defined as
“Whoever, being a public servant—commits an act relating to their office but constitutes an
unauthorized exercise of their official functions, knowing that such an act is unauthorized; or
refrains from performing a duty which is imposed upon them or which is clearly inherent in the
nature of their office.”
10. The defendant is being charged under the second prong of the aforementioned charge, specifically
being, “Whoever, being a public servant refrains from performing a duty which is imposed upon
them or which is clearly inherent in the nature of their office.”
11. The defendant, as a deputy within the Ridgeway County Sheriff’s Office, who holds an active
certification issued by the Law Enforcement Training Center, is bound by the RCSO department
handbook, and has undergone RCSO Academy Training.
12. The RCSO Handbook (Exhibit D), at Section 504 (“Legal Responsibility”), imposes specific duties
on deputies of the Sheriff’s Office. First, it establishes a duty to act upon observing criminal
activity: “Deputies of the Sheriff's Office have a duty to take appropriate action when witnessing a
commission of a crime.”. Second, it requires that deputies conduct arrests and citations in
accordance with governing law: “Employees of the Sheriff's Office shall follow all department
policies, state and county laws, game rules and developer mandates while conducting arrests,
citations, and dealing with civilians if applicable to rank”. Thirdly, it expressly prohibits violations of
clauses located in the handbook: “Employees of the Sheriff's Office shall not intentionally violate
any clause of this department handbook or any other department policy.”
13. Because the Defendant, AXCFTP, was trained on and bound by these provisions as a condition of
his certification and continued employment, the Defendant was aware, at the time of the incident,
that a duty existed to take appropriate action - including the seizure of an unlawfully possessed
firearm and the arrest of its possessor - upon witnessing the commission of a crime, and that a
knowing departure from that duty constituted a breach of both department policy and the duties of
his office.
14. Having witnessed the commission of a crime, the subject’s unlawful possession of an illegal
government-issued firearm, criminalised under RCC § 2.29 Unlawful Possession of a Firearm and
RCC § 2.26 Unlawful Possession of Government-Issued Equipment, the Defendant’s duty under
Section 504.1(a) to take appropriate action required, at minimum, seizure of the firearm and the
arrest of the subject. By failing to seize the firearm and failing to formally arrest the subject, the
Defendant refrained from performing duties specifically imposed upon him by departmental policy,
thereby violating RCC § 2.15 Official Misconduct under its second prong.

15. Furthermore, the defendant's own prior conduct establishes that he was personally aware that
unlawful firearm possession under RCC § 2.29 requires seizure of the firearm and arrest of the
possessor, as evidenced through the defendant’s own record of arrests that he has performed
(Exhibit C).
16. The State of Ridgeway Criminal Code (Exhibit B) directly defines Involuntary Manslaughter as,
“Whoever, having ignored a known or obvious risk, or who disregards the life and safety of
others, causes the death of another.”
17. The defendant’s actions, in their inability to perform their official duties, also led to the direct death
of the victim, lolboy133, by failing to properly confiscate the illegal weapon, and arrest the subject
for the aforementioned charges. By failing to do so, and releasing the subject, while still allowing
them to maintain possession of the firearm, the subject was able to shoot and kill the victim, an
action that could have been avoided if the defendant had properly performed their duties.
18. It is your affiant’s professional determination, that by knowingly allowing the subject in this matter
to possess an illegal firearm after having the same subject in detention where the firearm could
have been seized, the defendant directly contributed to the subsequent death that occurred
shortly thereafter, thus the defendant, ignored an obvious risk, and caused the death of the victim,
lolboy133, committing the act of RCC § 3.05 Involuntary Manslaughter.
19. Based on the above facts and circumstances, it is your affiant’s belief that probable cause exists to
warrant a Criminal Complaint to be filed against AXCFTP in violation of:
RCC § 2.15 Official Misconduct ON 1 count
RCC § 3.05 Involuntary Manslaughter ON 1 count
20. Based on all the foregoing, I respectfully request a Criminal Complaint be issued on AXCFTP for
the charges described in the immediately foregoing section of this affidavit.
