IN THE SUPERIOR COURT OF
THE STATE OF RIDGEWAY
THR33SIX8
Plaintiff,
v,
DOMINODOWNLOAD, ET AL,
Defendant.
[PROPOSED] OMNIBUS ORDER: (1)
GRANTING DEFENDANTS' RULE 12(c)
MOTION FOR JUDGMENT; (2) STRIKING
SUPPLEMENTAL CLAIMS.
Hon. Arthur_Chen
Docket Number: RSC-CV-6949
[PROPOSED] OMNIBUS ORDER
THIS MATTER came before the Court on Defendants' Omnibus Procedural Motion requesting
Judgment on the Pleadings pursuant to Ridgeway Rule of Civil Procedure 12(c) and a separate
Motion to Strike Plaintiff’s Supplemental Disclosures. The Court, having reviewed the moving
papers, the operative pleadings, and the prior records of this case, finds good cause to grant the
requested relief.
IT IS HEREBY ORDERED:
1. Defendants’ Motion for Judgment on the Pleadings under Rule 12(c) is GRANTED. The Court
finds that the original active controversy set forth in the Civil Complaint has been rendered
entirely moot as a matter of law because the responding executive agencies have fully complied
with the prior mandates issued by this Court.
2. The Court further finds that to the extent Plaintiff challenges subsequent employment or
agency review selections, such determinations fall squarely within the subjective character
evaluation metrics reserved to the appointing authority under 4 R. Stat. § 121.102(e) and 4 R.
Stat. § 121.103. Accordingly, this Court lacks administrative jurisdiction to review or disturb
those discretionary choices, and the Complaint fails to state a claim upon which relief can be
granted.
3. Defendants’ Motion to Strike is GRANTED. Plaintiff’s "Document of Disclosures" (Doc. 15)
and accompanying material briefs filed on or about July 19, 2026, were introduced without first
obtaining formal leave of Court to supplement the pleadings. Because Plaintiff failed to comply
with this mandatory procedural prerequisite, the entire filing and its attached exhibits are hereby
STRUCK from the record as procedurally defective.
4. Plaintiff’s Civil Complaint is DISMISSED WITH PREJUDICE in its entirety. This case is
hereby ordered CLOSED on the civil docket.
IT IS SO ORDERED.
DATED: This ______ day of __________________, 2026.
