Defendant
Case No.: RSC-CM-0389
Presiding: Magistrate Judge Gamer80sStyle
STATE'S RESPONSE TO THE COURT'S ORDER OF SEPTEMBER 28, 2026
The State of Ridgeway, by and through undersigned counsel, respectfully submits this response to
the Court's Order of September 28, 2026, and states as follows:
Count I
The State confirms its intention to continue prosecution of Count I, Official Misconduct, R.C.C. §
2.15.
Count II
The State does not seek reinstatement of Count II, Aggravated Battery Class II, R.C.C. § 3.08a, at
this time, and will proceed solely upon Count I. The State reserves the right to seek leave of Court
to bring any further charge supported by a properly tailored probable cause affidavit, should the
Rules of Criminal Procedure permit.
Procedural action
To advance Count I toward disposition, the State requests that the Court (a) accept the Defendant's

arraignment, and (b) enter a discovery schedule. The State stands ready to produce its discovery
promptly upon entry of that schedule.
WHEREFORE, the State respectfully requests that the Court accept this response as compliance
with its Order and set this matter for arraignment and discovery on Count I.
