THE STATE OF RIDGEWAY
IN THE SUPERIOR COURT FOR RIDGEWAY

Plaintiff,
v.
Acenxrblx and Xotlkz, both individually,
Defendants.
Hon. Gamer80sStyle
Case No. RSC-CV-8640
PLAINTIFF’S MOTION FOR ENLARGEMENT OF TIME TO RESPOND TO DEFENDANT’S
MOTION TO DISMISS
A. BACKGROUND
1. Plaintiff filed this civil suit against the Defendants on September 19, 2026.
2. The following day, on September 20, 2026 TonyBlony492 filed two Notices of
Appearance entering himself as the attorney of record for both of the Defendants.
3. On September 25, 2026 Defendants filed a Motion to Dismiss.
4. As of September 25, 2026 and the date of this filing being September 28, 2026 service
of process as required under Rid. R. Civ. P. 4 has still not yet been served upon either of the
Defendants. Rid. R. Civ. P. 4(7)(1) provides that service shall be made “within seven (7) days
after the filing of the complaint” which would bring the deadline for service to be September
26, 2026 and such a date has already passed.
5. A summons has still not been issued per Rid. R. Civ. P. 4(1)(1) and the fault therefore
can not be placed upon the Plaintiff.
6. Plaintiff’s response to Defendant’s Motion to Dismiss was due September 27, 2026.
B. PROCEDURALLY IMPROPER
7. Plaintiff asserts that it is procedurally improper to require him to respond within 48
hours to a motion when Defendant has not yet been served with process. Under Rid. R. Civ. P.
4(7)(1), Plaintiff is afforded seven days to serve the summons. Until service has been
completed, Plaintiff should not be expected to begin litigating substantive motions or filing
legal briefs on an expeditious 48-hour deadline. The Court had no basis to assume that Plaintiff
would complete service immediately rather than utilize the full period permitted by the Rules.
C. PLAINTIFF’S SPECIAL CIRCUMSTANCES
8. Plaintiff further asserts that the power to his household has been interrupted due to an
incident in the surrounding neighborhood. As a result, Plaintiff has been without electricity for
approximately 36 hours, substantially impairing his ability to prepare and file legal pleadings.
D. THE COURT’S SPECIAL CIRCUMSTANCES
9. Plaintiff recognizes that this Court is presently experiencing a significant backlog and
strain upon its judicial resources, as evidenced by the invocation of 3 R. Stat. § 111.001,
permitting a Visiting Justice of the Supreme Court to serve as a trial court judge due to the
backlog and recent judicial vacancy. Plaintiff respectfully submits that granting the requested
enlargement would likewise afford the Court additional time to address its existing caseload and
judicial obligations, rather than requiring the Court to address an expedited response that could
otherwise be resolved within an ordinary and slower course of proceedings. Such an
enlargement would therefore serve the interests of both the parties and the Court by reducing
unnecessary urgency while allowing the Court additional time to manage its docket and allocate
its limited judicial resources.
E. LACK OF EFFECT ON DEFENDANT
10. Granting this motion would not negatively impact Defendant, nor would it cause
undue delay, reflect bad faith or a dilatory motive, or result in any prejudice to Defendant.
REQUESTED RELIEF
WHEREFORE, Plaintiff respectfully requests that this Court enter an order:
A. Grant Plaintiff an additional five (5) days to file a response to Defendant's motion;
B. Order the Clerk of the Court to issue and provide Plaintiff with a summons for service
upon Defendant pursuant to Rid. R. Civ. P. 4;
C. Order that the Court's record be amended to reflect that Plaintiff may appear and
speak in proceedings conducted through Discord; and
D. Grant such other and further relief as this Court deems just and proper.
Respectfully submitted, /s/ takosull1
