THE STATE OF RIDGEWAY

THROWMORETHANSIX, an individual,

-against-
CHEXBURGER, in his official capacity as a

Office,
Defendant.

COMPLAINT
Presiding Judge: Hon. N/A
Plaintiff throwmorethansix, proceeding with his counsel of record thr33six8, esq., hereby
files this complaint to commence the above-titled civil action. It is alleged as follows:
PARTIES
1. Defendant chexburger is a resident of the State of Ridgeway, and he is a corporal of the
Ridgeway County Sheriff's Office, which is established by 9 R. Stat. § 331.001 as the
sheriff's office of the County of Ridgeway. He has been employed there since
2026-07-08, and he has held his peace officer certification from the Law Enforcement
Training Center since 2020-12-20. His timezone is either UTC–06:00 or UTC–07:00.
2. Plaintiff throwmorethansix is a tourist of the State of Ridgeway. His timezone is
UTC–07:00.
JURISDICTION AND VENUE
3. This court, which is the Superior Court of the State of Ridgeway, shall "shall exercise
original jurisdiction for all civil and criminal cases or controversies under the rules as set
by the Supreme Court", Rid. Const., Art. Ⅴ, § Ⅳ, and it shall have original jurisdiction
over, among other things, "any controversy not otherwise falling within the jurisdiction of
the Supreme Court, Administrative Court, or Magistrate Court as set forth by law". See
generally The Judiciary Act of 2026 § 302, S.B. 002, 11th Sen. (2026); 3 R. Stat. §
131.104(a–e). As the controversy is actionable here, jurisidiction is proper.
4. This court is the proper venue because civil actions shall only take place in the county
where the controversy occurs. See 7 R. Stat. §§ 131.001–131.003. Since this takes place
within the County of Ridgeway, a county of the State of Ridgeway pursuant to 9 R. Stat.
§ 321.001, venue is proper.
STATEMENT OF FACTS
5. On September 23rd, 2026, at 8:15:15 p.m. (UTC–07:00), Plaintiff just joined the State of
Ridgeway game, and spawned in the City of Palmer. He did not have anything on him
except a protest sign, which all players get upon joining. He was only wearing a black
graphic t-shirt and black pants.
6. He walked to the car dealership, and he spawned a blue Gridlock.
7. In the parking lot, Defendant chexburger, who was wearing the standard RCSO uniform,
was in a marked Madrigal, closely observed Plaintiff.
8. Defendant chexburger saw that Plaintiff was not bearing (i.e., carrying around his person)
a firearm.
9. Defendant chexburger only saw Plaintiff open the trunk of his vehicle. See Ante, at ¶ 6.
10. Defendant chexburger then got out of his vehicle and began running toward Plaintiff with
a taser drawn.
11. Defendant chexburger said nothing during the chase. Ante, at ¶ 10.
12. When Plaintiff came back into the car dealership, Defendant forcefully handcuffed
Plaintiff without saying anything.
13. Defendant took Plaintiff to his vehicle, and he was then juggled between RSP Cpl. Libres
and Tpr. dzdreams.
14. Defendant then booked Plaintiff for the misdemeanor of Unlawful Possession of a
Firearm, R.C.C. § 2.29. He put the following as the arrest description: "Palmer limits;
Entered trunk of van. Appeared to have strap decal display on front of person. Search
resulted in multiple boxes of ammunition. Tourist with no RFLID; PCD."
TORTS
#1: Deprivation of Rights under Color of Law (7 R. Stat. § 121.403)
Tortfeasor: Defendant chexburger
15. Defendant chexburger, as a deputy sheriff empowered to perform, inter alia, warrantless
arrests pursuant to 9 R. Stat. § 331.201(d), arrested Plaintiff based upon the behavior that
the deputy observed at Ante, at ¶ 6.
16. The Fourth Amendment of the U.S. Constitution requires probable cause for warrantless
arrests. E.g., Maryland v. Pringle, 540 U.S. 366, 370 (2003) ("A warrantless arrest of an
individual in a public place for a felony, or a misdemeanor committed in the officer’s
presence, is consistent with the Fourth Amendment if the arrest is supported by probable
cause."); United States v. Humphries, 372 F. 3d 653 (CA4 2004) ("Under the Fourth
Amendment, if supported by probable cause, an officer may make a warrantless arrest of
an individual in a public place.").
17. Rid Const., Art. Ⅰ, § Ⅷ, which mimics Vt. Const., ch. Ⅰ, art. Ⅺ1, requires the same.
E.g., State v. Chicoine, 2007 VT 43, ¶¶ 7–8 (2007).
18. Defendant did not see Plaintiff with a firearm. Ante, at ¶¶ 5, 9.
19. Therefore, Defendant had no probable cause to arrest Plaintiff, violating Plaintiff's Fourth
Amendment and Section Eight rights. See Id., at ¶¶ 16–17.
20. Therefore, there is a cause of action for the tort of deprivation of rights under color of
law, of which Defendant chexburger is the tortfeasor.
#2: Official Misconduct (7 R. Stat. § 121.404)
Tortfeasor: Defendant chexburger
1 See State v. Lx1nas, 1 Rid. 46, 51 (2022) ("We believe that where a provision from our Constitution has obviously
been derived from a provision of a real-life state constitution, we should adopt the interpretation of the provision
from that state’s highest appellate court.")
21. As Defendant is the tortfeasor of deprivation of rights, and Plaintiff has been booked as a
result of the tortious arrest, Defendant has also committed the tort of official misconduct.
22. Therefore, there is a cause of action for the tort of Official Misconduct, of which
Defendant chexburger is the tortfeasor.
PRAYER FOR RELIEF
Plaintiff is entitled to and requests the following:
1. $10,000 in punitive damages from Defendant mp5sopmods in his individual capacity
pursuant to 7 R. Stat. § 121.404, and;
2. any other relief that this Court deems proper. See Rid. Rule Civ. Proc. 8(1) ("Relief in the
alternative or of several different types may be demanded.")
Respectfully submitted,
throwmorethansix
