IN THE SUPERIOR COURT OF THE
STATE OF RIDGEWAY
Halo4isin
Plaintiff,
v,
Ridgeway Parks Service,
Defendant.
MOTION TO STRIKE
Hon. EffortlessBrit
Docket Number: RSC-CM-0750
DEFENDANT’S MOTION TO STRIKE
COMES NOW, Defendant, Ridgeway Parks Service (RPS), by and through its counsel, Assistant
Attorney General wynneboy2010, respectfully submits this that this Court under Rid. R. Civ. P. 12(3)
and Rule 7 to strike the completely new claim introduced via Plaintiff's recent supplemental filing. In
support of this motion, Defendant states with particularity the following grounds:
1. On August 20, 2026, this Court entered an Order on Plaintiff's Motion for Partial Summary
Judgment, resolving the underlying legal interpretation of 4 R. Stat. § 122.402(f) and directing
specific re-evaluation deadlines.
2. Subsequent to that ruling, Plaintiff transmitted a supplemental document introducing a
completely new claim into this active action without following the required procedures under
the Ridgeway Rules of Civil Procedure.

3. Under Rule 13(4)(2), the timeframe to join other parties and amend the pleadings is strictly
fixed by the scheduling order. Rule 13(5) explicitly states that a schedule fixed under this rule
may be modified only for good cause and with the judge’s consent, on motion or on the court's
own initiative. It further explicitly declares that a stipulation of the parties does not modify a
schedule.
4. Plaintiff did not move for, nor receive, leave of court to amend the pleadings or modify the
scheduling order to inject this brand-new claim.
5. Under Rule 10(8)(1) and Rule 11(10)(1), a failure to comply with the mandatory rules
governing pleading amendments and scheduling restrictions is explicit grounds for a motion
to strike.
6. Because this new claim was introduced without the required leave of court or an order
modifying the schedule under Rule 13(5), it is procedurally non-compliant, immaterial, and
improper.
WHEREFORE, Defendant respectfully requests that this Court grant its motion and order Plaintiff's
unauthorized new claim and supplemental document stricken from the record.
