PROPOSED ORDER ON PLAINTIFF’S MOTION TO DISREGARD
UNAUTHORIZED SECOND OPPOSITION OR, ALTERNATIVELY, F OR LEAVE
Upon consideration of Plaintiff’s Motion concerning Defendant’s second opposition, the record,
and Rid. R. Civ. P. 7.1(5), the Court ORDERS as follows:
1. Rid. R. Civ. P. 7.1(5) provides that, after an opposition and reply, no further paper shall
be filed on the motion without leave of Court.
2. Defendant’s second Opposition was filed after Plaintiff’s reply and without prior leave of
Court. Accordingly, the second Opposition is DISREGARDED for purposes of deciding
Plaintiff’s Supplemental Motion.
OR, IN THE ALTERNATIVE:
3. If the Court elects to consider Defendant’s second Opposition, Plaintiff is GRANTED
leave under Rule 7.1(5) to file the Proposed Short Response attached to Plaintiff’s
Motion, and that response is deemed filed as of the date of this Order without requiring
an additional briefing cycle.
4. Any claim of privilege concerning the requested records shall be asserted with the
particularity required by Rid. R. Evid. 501(g), 504(i), and 506(f). No privileged material
shall be transmitted through the electronic filing system for purposes of establishing the
claim.
5. To the extent a privilege claim cannot be resolved from the required description, the
Court may direct presentation of the disputed item outside the electronic filing system for
in camera review as provided by Rid. R. Evid. 501(i)-(k), 506(g)-(h), and Rid. R. Civ. P.
32(6)(b)(3).
6. No further paper concerning the pending Supplemental Motion shall be filed by either
party without specific leave of Court.
