This matter is before the Court on its own motion and having reviewed the record, the Court
finds:
1. On the 26th of July, 2026 at 4:10 AM UTC, Defendant was arraigned and entered a plea
of not guilty on all counts. On that date, a speedy trial deadline was set for the 9th of
August, 2026.
2. Under Rule 14, subdivision (a)(1)(A) All automatic discovery was to be made not later
than forty-eight (48) hours after arraignment, that is, the 28th of July, 2026 at 4:10 AM
UTC, unless the Court extended the period under Rule 46 or continued the case under
Rule 10. This was not done.
3. Until the 28th of July, 2026, the State had yet to file its Certificate of Compliance or
automatic discovery. Take notice also that the submission of any incomplete document is
not a filing and does not commence under any period pursuant to subsection
[(a)(1)(A)(5)].
4. On the 27th of July, 2026, the Court set this matter for a pretrial hearing under Rule 11(b)
and telecommunicated notice by the relevant Discord channel. The State failed to appear.
5. Periods under this rule run continuously in hours from the recorded timestamp, without
regard to court days, and are self-executing. The absence of any notice from the
electronic filing system does not extend them. Subdivision (a)(1)(A)(4).
1
6. The State requested no continuance and no extension, and there is no reason provided by
the State for not complying. The State does not contest that it did not comply.
Upon consideration of the record of this action, and for good cause shown, it is hereby ordered
that this action is DISMISSED WITH PREJUDICE for failure to prosecute.
