Case No. RSC-CV-0750
REVISED PROPOSED ORDER
REVISED PROPOSED ORDER ON PLAINTIFF’S SUPPLEMENTAL MOTION
FOLLOWING DEFENDANT’S OPPOSITION
Upon consideration of Plaintiff’s Supplemental Motion for Limited Discovery, Preservation,
Protective Relief, and Leave to Supplement, Defendant’s Opposition, Plaintiff’s Reply, and the
record in this action, the Court finds that Defendant has represented that it possesses specific
evidence supporting the challenged 4 R. Stat. § 121.102(e) determination, while that evidence
and the relevant post order administrative record have not yet been introduced into the judicial
record. Narrow preservation and production are therefore appropriate before the Court makes
any final determination concerning retaliation, bad faith, official misconduct, or the ultimate
validity of the post order Final Outcome.
IT IS HEREBY ORDERED:
1. Defendant shall immediately preserve all application tracker data, Google Sheet version
history, audit logs, cell edit history, notes, comments, formulas, evaluation records, and
nonprivileged communications concerning Plaintiff’s post August 20, 2026 reevaluation,
Final Outcome, and § 121.102(e) character determination.
2. Within forty eight (48) hours of this Order, Defendant shall produce the actual
communications, statements, screenshots, incidents, complaints, or other factual material
relied upon in asserting that Plaintiff engaged in rude, hostile, disrespectful, defamatory,
slanderous, or otherwise disqualifying conduct under § 121.102(e).
3. Within forty eight (48) hours, Defendant shall produce the tracker version history and
available audit information sufficient to identify: (a) when the Failed Final Outcome was
first entered; (b) when the § 121.102(e) rationale was first entered, edited, or modified;
and (c) the account or person responsible for each relevant change.
4. Within forty eight (48) hours, Defendant shall identify every person who recommended,
made, entered, edited, communicated, or approved the Final Outcome or § 121.102(e)
character determination, and shall identify the person who possessed final
decisionmaking authority.
5. Within forty eight (48) hours, Defendant shall identify the specific character defect, act,
incident, statement, or course of conduct relied upon, the asserted connection between
each ground and harm to the health of the Parks Service or community, and the attributes
of merit and demerit actually considered and weighed under 4 R. Stat. §
121.101-121.103.
6. If Defendant contends that responsive material is privileged or otherwise protected from
disclosure, Defendant shall identify the withheld category and basis for withholding and
shall submit the disputed material to the Court in camera upon request. Nothing in this
Order requires disclosure of privileged attorney client communications to Plaintiff.
7. No party or RPS personnel shall delete, alter, overwrite, conceal, or cause the loss of any
responsive tracker history, audit data, communications, notes, or evaluation material
pending completion of production and further order of the Court.
8. Pending completion of production, the application coordinator and any person identified
as an author or approver of the challenged § 121.102(e) entry shall not take further
discretionary action on Plaintiff’s application, except as necessary to preserve records or
comply with Court orders. In the alternative, if the Court declines this paragraph, all
discretionary changes to Plaintiff’s application shall be documented contemporaneously
with the identity of the decisionmaker and stated basis until further order.
9. Plaintiff is granted leave under Rid. R. Civ. P. 10(d) to file a supplemental pleading
within forty eight (48) hours after completion of production if the newly produced
evidence supports a claim arising from post pleading events. In the alternative, the Court
reserves the supplementation issue until production is complete and denies Defendant’s
request to foreclose supplementation at this stage.
10. The Court makes no present finding that any individual engaged in retaliation, bad faith,
evidence manipulation, deprivation of rights, or official misconduct. Those issues, if
raised, shall be determined on the developed record.
11. The Court retains jurisdiction to issue further discovery, protective, equitable, or
injunctive relief as necessary after production.
SO ORDERED.
