THE STATE OF RIDGEWAY
IN THE SUPERIOR COURT OF RIDGEWAY
DAUNTEWRIGHT22, IN HIS CAPACITY AS A TAXPAYING FARMING RESIDENT, Petitioner,
v.
AXCFTP, in his official capacity as a law enforcement officer in the Ridgeway County Sheriff's Office,
pursuant to 7 R. Stat. § 133.002,
Respondent.
PETITION FOR HABEAS CORPUS
Proceeding without counsel, Petitioner DAUNTEWRIGHT22 hereby files this Petition for Habeas Corpus and
alleges as follows against Respondent:
PARTIES AND JURISDICTION
1. Petitioner DAUNTEWRIGHT22 is entitled to file a petition for habeas corpus subsequent to an arrest.
1. Respondent AXCFTP is the proper Respondent in this matter in his official capacity as a law
enforcement officer with the Ridgeway County Sheriff's Office.
2. Jurisdiction and venue are proper pursuant to 7 R. Stat. § 133.004.
GENERAL ALLEGATIONS
1. On or about [9/18/2026], Petitioner was lawfully present inside his private residence.
2. Respondent AXCFTP arrived at Petitioner's residence and asserted that Petitioner had previously fled
from law enforcement.
3. The available video evidence depicts Petitioner inside his residence and does not depict Petitioner
operating a vehicle, engaging in a pursuit, fleeing from law enforcement, or committing any offense
alleged by Respondent.
4. At no point in the video evidence submitted by Respondent is Petitioner shown operating a vehicle,
engaging in a pursuit, or fleeing from law enforcement.
5. Despite the absence of evidence establishing the alleged offense, Respondent and accompanying
officers approached Petitioner's residence.
6. Respondent and/or accompanying officers forcibly breached Petitioner's front door and entered the
residence.
7. Upon entry, Respondent deployed a taser against Petitioner.
8. Petitioner was subsequently placed under arrest and transported to jail.
9. During the incident, Respondent stated words to the effect of "rot in jail."
1. Respondent further asserted that the existence of a BOLO was sufficient authority to enter a private
residence.
2. Petitioner is informed and believes that a BOLO alone does not constitute lawful authority to enter a
private residence absent a warrant or other recognized legal exception.
3. Petitioner posted bail shortly after the arrest and was released from custody.
4. The Constitution of the State of Ridgeway provides that the people have a right to hold themselves,
their houses, papers, and possessions free from search and seizure absent sufficient legal justification.
5. Respondent entered Petitioner's residence, deployed a taser upon Petitioner, and arrested Petitioner
despite the absence of evidence establishing the alleged offense for which Petitioner was accused.
6. The available evidence fails to demonstrate that Petitioner committed the offense alleged by
Respondent.
7. The arrest and detention of Petitioner were therefore unlawful.
8. Furthermore, Respondent's reliance upon a BOLO as justification for entering Petitioner's residence is
inconsistent with the constitutional protections afforded to the people of the State of Ridgeway.
9. For the foregoing reasons, the arrest, detention, and resulting criminal charges against Petitioner were
unlawful and warrant equitable relief, including expungement of Petitioner's arrest record and such
other relief as this Court deems just and proper.
PRAYER FOR RELIEF
WHEREFORE, Petitioner respectfully requests that this Court:
A. Issue a writ of habeas corpus pursuant to 7 R. Stat. § 133.001 and § 133.004 and declare Petitioner's
detention unlawful;
B. Order the expungement of Petitioner's arrest and any charges arising from the unlawful detention described
herein;
C. Order the government to reimburse Petitioner for all filing fees, court costs, and other expenses incurred in
connection with this action; and
D. Grant such other and further relief as this Court deems just and proper.
Respectfully submitted,
/s/ DAUNTEWRIGHT22
