PLAINTIFF’S MOTION FOR
VOLUNTARY DISMISSAL
WITHOUT PREJUDICE
The Plaintiff, Adam Stratton, moves the Court to dismiss this action without prejudice. In
support, he states:
1. The Plaintiff began this action by a complaint against the Defendant arising from the
Plaintiff’s arrest at the State Capitol on September 16, 2026, docketed as No. DCE-2026-
0101.
2. The Plaintiff no longer wishes to pursue this action at this time. He asks that it be dismissed
in its entirety, including the original complaint and any amended pleading, and that any
request for the issuance or service of a summons be treated as withdrawn.
3. Dismissal without prejudice injures no one. The Defendant gives up no defense, and the
Plaintiff seeks no costs.
WHEREFORE, the Plaintiff respectfully requests that the Court dismiss this action in its
entirety, without prejudice, with each party to bear its own costs, and grant such further relief as the
Court deems just and proper. A proposed order is submitted with this motion.
