Upon consideration of Plaintiff’s Supplemental Motion, the record in this action, and for good
cause shown, it is hereby ORDERED:
1. Defendant shall immediately preserve all application tracker data, Google Sheet version
history, audit logs, notes, comments, cell edit history, evaluation records, and
nonprivileged communications concerning Plaintiff’s Final Outcome and the §
121.102(e) character rationale.
2. Within forty eight (48) hours of this Order, Defendant shall produce the tracker version
history and available audit information sufficient to identify: (a) when the Failed Final
Outcome was first entered; (b) when the § 121.102(e) explanation was first entered or
modified; and (c) the account or person responsible for each relevant change.
3. Within forty eight (48) hours, Defendant shall identify every person who made,
recommended, entered, edited, or approved the Final Outcome or the § 121.102(e)
character determination.
4. Within forty eight (48) hours, Defendant shall identify the specific character defect, act,
incident, statement, or course of conduct relied upon under § 121.102(e), the material
factual basis for each ground, and the asserted connection between each ground and harm
to the health of the Parks Service or community.
5. Within forty eight (48) hours, Defendant shall identify the attributes of merit and demerit
actually considered and weighed under 4 R. Stat. §§ 121.101-121.103.
6. Pending completion of the foregoing production and further order of this Court, the
application coordinator and any person identified as an author or approver of the
challenged § 121.102(e) entry shall not take further discretionary action on Plaintiff’s
application, except as necessary to preserve records or comply with this Order.
7. Plaintiff is granted leave under Rid. R. Civ. P. 10(d) to file a supplemental pleading
within forty eight (48) hours after completion of the ordered production if Plaintiff
determines that the new evidence supports a claim arising from events occurring after the
operative filing.
8. The Court retains jurisdiction to impose further equitable or injunctive relief if the
production demonstrates noncompliance with prior orders, arbitrary or biased review,
retaliation, deprivation of rights, official misconduct, or other unlawful conduct.
SO ORDERED.
