Plaintiff moves to strike the defendant's motion to dismiss.
PROCEDURAL JUSTIFICATION FOR MOTION
Any party may move to strike "any redundant, immaterial, impertinent, or scandalous
matter". Rid. Rule Civ. Proc. 12(3).
GROUNDS
1. Per rules, a motion to dismiss is not a responsive pleading, so it cannot substitute an
answer, which the defendants have not filed.
Exactly what it says on the tin. See Rid. Rule Civ. Proc. 7(1) ("motion to dismiss" is not
included in the list of allowed pleadings). As the record reflects, the defendants have not filed an
answer in this civil action.
RELIEF SOUGHT
Plaintiff requests the following:
1. That the defendants' motion to dismiss, of which the Bates number is
BATES-20260809-1795610273, be STRUCK.
