MOTION TO DISMISS
Defendant WGT05, respectfully moves the Court to dismiss the above titled action on the grounds that the
initial (refiled) complaint is insufficient in process in accordance with the rules of civil procedure. In support of
this Motion, Defendant states as follows:
BACKGROUND
1. On or about the 3rd of August, 2026, Attorney thr33six8, on behalf of Plaintiffs Tripiafer23,
masterqv, submitted an Initial Filing to the Superior Court of Ridgeway. thr33six8 signed as
“Attorney of Plaintiffs/Clients masterqv and Tripiafer23.”
2. The aforementioned Initial filing identifies thr33six8 appearing as counsel for both Plaintiffs in
this action.
3. Attorney thr33six8’s bar certification was suspended ‘indefinitely’ on the 5th of August, 2026.
See Exhibit A for details.
BASIS FOR MOTION
4. As of Attorney thr33six8’s bar suspension, opposing counsel no longer qualifies under 3 R. Stat.
§ 151.006, as thr33six8’s status as an attorney is no longer active, barring him from practicing
law or appearing on behalf of another individual within the State of Ridgeway… “"Every
attorney duly admitted or authorized to practice law in this state shall have the right to appear
before any court of the state, or any public board, committee, or office in the interest of any
client…"
5. thr33six8’s legal authority to continue practicing litigation, signing papers, filing documents, or
otherwise conducting legal affairs is rendered moot by the Ridgeway State Bar. See Exhibit A for
details.
6. Rw. R. Civ. P. 11(b)(1), “The filing of any pleading, motion, or other paper shall constitute an
appearance by the attorney who signs it, unless the paper states otherwise.”
7. Rw. R. Civ. P. 12(a)(3), “Insufficiency of process;” listed as a reason to file a motion to dismiss
in absence of a claim for relief in any pleading.
REQUESTED RELIEF
WHEREFORE, Defendant respectfully requests that the Court:
1. Determine that Attorney (suspended) thr33six8 no longer possesses the legal authority to
practice, appear on behalf of Plaintiffs, or otherwise conduct legal affairs for Plaintiffs as
established by 3 R. Stat. § 151.006;
2. Determine that thr33six8 is not presently authorized to represent Plaintiffs in this action;
3. Strike opposing counsel's Initial Filing submitted on the 3rd of August, 2026;
4. Dismiss the complaint without prejudice;
5. Grant such other relief as the Court finds just and proper.
