MOTION TO STRIKE APPEARANCE OF OPPOSING COUNSEL
Defendant WGT05, respectfully moves the Court for an order striking the appearance of thr33six8 as counsel
for Plaintiff. In support of this Motion, Defendant states as follows:
BACKGROUND
1. On or about the 26th of July, 2026, Attorney thr33six8, on behalf of Plaintiff, submitted an Initial
Filing to the Superior Court of Ridgeway.
2. On or about the 28th of July, 2026, Attorney thr33six8, on behalf of Plaintiff, submitted a Notice
of Appearance in the matter Icecoldwateryes v. WGT05 RSC-CV-8006.
3. The aforementioned Notice of Appearance identifies thr33six8 appearing as counsel for Plaintiff
Icecoldwateryes, “thr33six8 Esq. has filed this notice of appearance in order to invoke his
statuatory right to appear on behalf of the client, who is Plaintiff Icecoldwateryes, before this
court. See The Judiciary Act of 2026 § 504, S.B. 001, 11th Sen./3 R. Stat. § 151.006 ("Every
attorney duly admitted or authorized to practice law in this state shall have the right to appear
before any court of the state, or any public board, committee, or office in the interest of any
client…"). ”
4. Attorney thr33six8’s bar certification was suspended ‘indefinitely’ on the 5th of August, 2026.
See Exhibit A for details.
BASIS FOR MOTION
5. As of Attorney thr33six8’s bar suspension, opposing counsel no longer qualifies under 3 R. Stat.
§ 151.006, as thr33six8’s status as an attorney is no longer active, barring him from practicing
law or appearing on behalf of another individual within the State of Ridgeway… “"Every
attorney duly admitted or authorized to practice law in this state shall have the right to appear
before any court of the state, or any public board, committee, or office in the interest of any
client…"
6. thr33six8’s legal authority to continue practicing litigation, signing papers, filing documents, or
otherwise conducting legal affairs is rendered moot by the Ridgeway State Bar. See Exhibit A for
details.
REQUESTED RELIEF
WHEREFORE, Defendant respectfully requests that the Court:
1. Determine that Attorney (suspended) thr33six8 no longer possesses the legal authority to
practice, appear on behalf of Plaintiff, or otherwise conduct legal affairs for Plaintiff as
established by 3 R. Stat. § 151.006;
2. Determine that thr33six8 is not presently authorized to represent Plaintiff in this action;
3. Strike opposing counsel's Notice of Appearance filed on the 28th of July, 2026;
4. Prohibit thr33six8 from filing papers, motions, pleadings, or any other legal documents in this
action;
5. Revoke thr33six8’s access to Icecoldwateryes v. WGT05 case channel;
6. Stay applicable deadlines, including the active deadline for defenses initial response indefinitely
until Plaintiff acquires new counsel;
7. Grant such other relief as the Court finds just and proper.
