FINDINGS OF FACT
1) On July 22nd, 2024, the respondent was issued an involuntary general discharge as a
result of an OTI Investigation.
2) The respondent did not meet his contractual obligations as set out in DA-10 Standard
Search Agreement for an exit search.
FINDINGS OF LAW AND POLICY
1) The respondent’s failure to uphold his contractual obligations to have his possessions
searched, as agreed to in DA-10 [see exhibits B, C & D], does constitute a violation of the
Ridgeway County Transit Authority Handbook, contrary to policy 301-2.5.
2) The respondent did not desert the Ridgeway County Transit Authority and therefore
didn’t violate policy 301-2.4 of the Ridgeway County Transit Authority Handbook.
a) The respondent was served with a disciplinary report by saladroo [see exhibit F],
within this report it gives notice that the employee has “been dismissed from
[their] position as an employee of the Ridgeway County Transit Authority.”
RECOMMENDATIONS
1) The applicant has requested to dishonourably discharge the respondent from the
Ridgeway County Transit Authority.
2) The respondent has already been issued an involuntary general discharge from the
Ridgeway County Transit Authority, as a result of case #132 and thus cannot be
dishonourably discharged.
3) The applicant is not entitled to take any further action.
a) This is not to be construed as barring the applicant from carrying out any action in
relation to the aforementioned involuntary general discharge, such as exiling the
respondent from the group.
CERTIFICATION
I, the Administrative Court Judge duly assigned to hear this matter, do hereby certify the
findings of this hearing, and have forthwith put the recommendations as part of this report.
These findings are findings of my own, and purely my own without any outside interference or
coercion. I make this recommendation in good faith, under pains and penalties of perjury, and
that it is not the result of bias, prejudice, or other unlawful influence on my own judgment.
ADMINISTRATIVE COURT JUDGE
NOTICE OF EXPEDITED HEARING
1) On, or about, the 23rd of July 2024 the respondent appeared after being summoned and a
hearing was begun.
2) On, or about, the 25th of July 2024 the respondent left the Discord midway through the
hearing and refused to rejoin, see case transcript for more information.
3) The applicant motioned for an expedited hearing, which was granted in accordance with
the Employee Desertion Act.
4) The testimony and admitted evidence derived from the initial hearing shall be included in
the appendix of evidence.
