MOTION TO DISMISS
Defendant Azlaewent_Ofiicial, through attorney of record andysofun, moves to dismiss all charges
against him in the aforementioned case with prejudice.
ARGUMENT
The prosecution’s criminal information charges Azlaewent_Ofiicial with one count of Evidence Theft
which is a misdemeanor. The information alleges that this criminal offense occurred “On May 4th, 2024, at
around 12:37 UTC +01.” The Statute of Limitations Act S1-027 demands that, “No misdemeanor charges shall
be filed, refiled, or investigated by the State if the act which offended the State occurred ninety (60) days prior
to the filing of a Criminal Information or other forms of initiating a criminal proceeding.”1 Under that statute, if
the criminal information was filed more than 60 days after May 4th, 2024, then the Evidence Theft charge must
be dismissed.
The criminal information was filed against Azlaewent_Ofiicial by prosecutor Commander1567 on the
4th of July, 2024.2 There are 61 days between 05/04/2024 and 07/04/2024.3 As the Statute of Limitations
expired by the time the criminal information was filed, the Evidence Theft charge against Azlaewent_Ofiicial
must be dismissed. According to the Statute of Limitations Act, “In the advancement of justice, the State must
always bring its claims against the accused with utmost haste.” The State has failed in that duty.
