REPORT AND RECOMMENDATIONS
IN THE MATTER OF AN APPLICATION
UNDER SECTION 1.3 OF THE ADMINISTRATIVE PROCEDURE ACT
I. Introduction
[1] Under Section 1.3 of the Administrative Procedure Act, Assistant Superintendent
ConstantlyVerbal of the Ridgeway Parks Service applied for an Administrative
Hearing in order to discharge the respondent from the department on May 23rd, 2024.
[2] The application named ENDOFLUFFFLUFFINGTON, an employee of the
Ridgeway Parks Service, as the respondent.
[3] The application has established the department’s desire to dishonourably discharge
ENDOFLUFFFLUFFINGTON, due to the fact that they have engaged in a number of
crimes while failing to report them.
[4 Because the respondent has failed to appear for his Administrative Hearing, the
applicant has filed a brief requesting for an expedited ruling in accordance with
Section 3.1 of the Employee Desertion Act.
[5] I am satisfied that the respondent has failed to appear before the Administrative
Court. As a result of this, the hearing shall be bypassed.
[6] All factual allegations are assumed as true, having gone uncontested by the
respondent, and are reproduced in Part II.
II. Findings of Fact
[7] On or around May 8th, 2024, it was reported to the Ridgeway Park Service’s
Internal Affairs Unit that Park Ranger I ENDOFLUFFFLUFFINGTON (hereinafter
“Endo”) had used a department-issued Wesler to shoot and cause the death of Trooper
Gurra059 of the Ridgeway State Police while on-duty.
[8] An investigation was launched and after review of testimony from parties involved,
it was clear that Park Ranger I Endo did cause the death of Trooper Gurra059 after
Gurra059 failed to answer Endo's question.
[9] The investigation revealed that Park Ranger I Endo inappropriately used his
department-issued Wesler to shoot and cause the death of Gurra059 without lawful
cause.
[10] The investigation further revealed that Park Ranger I Endo violated the Use of
Force policy by applying unnecessary or excessive force on Trooper Gurra059 of the
State Police.
[11] On or around May 8th, 2024, it was reported to the Ridgeway Park Service’s
Internal Affairs Unit that Park Ranger I Endo was arrested by a law enforcement
officer for Unlawful Discharge of a Firearm and First-Degree Murder.
[12] An investigation revealed that Endo failed to report this arrest to the Internal
Affairs Unit upon its issuance and that Endo was indeed arrested on these charges.
[13] On or around May 8th, 2024, it was reported to the Ridgeway Park Service’s
Internal Affairs Unit that Park Ranger I Endo was arrested by a law enforcement
officer for First-Degree Murder and Unlawful Possession of Government-Issued
Equipment.
[14] An investigation revealed that Endo failed to report this arrest to the Internal
Affairs Unit upon its issuance and that Endo was indeed arrested on these charges.
[15] On or around May 8th, 2024, the Park Service Internal Affairs Unit received a
video clip where it shows Park Ranger I Endo utilizing a department-issued TB26
taser, an extendable baton, and a radio while off-duty.
[16] Park Ranger I Endo used the TB26 taser and baton to strike and kill a Palmer
Police Department Officer at the Palmer Car Dealership.
[17] Per department policy, no employee shall have any department-issued equipment
in theirpossession while off-duty and/or on any other team other than the Ridgeway
Park Service team.
[18] On or around May 13th, 2024, it was reported to the Ridgeway Park Service’s
Internal Affairs Unit that Park Ranger I Endo was arrested by a law enforcement
officer for Vehicular Assault.
[19] An investigation revealed that Endo failed to report this arrest to the Internal
Affairs Unit upon its issuance and that Endo was indeed arrested on these charges.
[20] On or around May 13th, 2024, it was reported to the Ridgeway Park Service’s
Internal Affairs Unit that Park Ranger I Endo was arrested by a law enforcement
officer for First-Degree Murder.
[21] An investigation revealed that Endo failed to report this arrest to the Internal
Affairs Unit upon its issuance and that Endo was indeed arrested on these charges.
III. Findings of Law and Policy
[22] The handbook of the Ridgeway Park Services establishes that by engaging in
behaviour which is criminal and receiving an arrest for it, it is a violation of policy and
as such is deserving of a dishonourable discharge.
[23] Because of the fact that the respondent has received a record, I am satisfied that
he should receive a dishonourable discharge from the Ridgeway Parks Service.
IV. Recommendations
[24] The applicant recommends termination of the respondent’s employment from the
Ridgeway Parks Service in the nature of a dishonourable discharge.
[15] The applicant is entitled to take any action up to and including an dishonourable
discharge.
