DOCKET NO. RSC-CM-2721
v.
NOHATALEX
Defendant
MINUTE ORDER
THIS CAUSE comes before the court upon Defendant nohatalex’s motion for postconviction
relief to vacate the conviction entered by the court on the grounds of ineffective assistance of counsel.
The Court finds that the motion fails to comply with the requirements set forth in Rid.R.Crim.P.
30(c)(3), which mandates that moving parties shall file and serve affidavits in support of their
position(s). The absence of an affidavit in support of the Defendant's motion precludes the Court from
assessing the merits of the claims presented.
IT IS HEREBY ORDERED that the Defendant's Motion for Postconviction Relief is DENIED
for failure to include an affidavit as required by Rid.R.Crim.P. 30(c)(3).
IT IS SO ORDERED this 29th day of April in the year of our Lord two thousand and twenty-four and
the year of our republic, two hundred and forty-seven.
