DOCKET NO. RSC-CV-2668
Petitioner
v.
TAXESARENTAWESOME, in his official
capacity as a Ridgeway County Deputy Sheriff
Respondent
ORDER
THIS CAUSE comes before the court on the petition of afik4333 (hereinafter “Petitioner”) for a
writ of habeas corpus seeking the vacatur of a criminal record pursuant to Rid. R. Civ. P. 54(a)(1). The
Court has reviewed the petition submitted by counsel. The State of Ridgeway has refused to contest or
challenge the petition and has summarily agreed with the petition’s facts and conclusions. The court
understands the charge of witness tampering, as defined by R.C.C. § 1.06, as designated for judicial use
only and not for the initiation of an arrest by law enforcement without the issuance of a warrant by a
judicial officer. Therefore, the arrest based on this charge was outside the lawful authority of Deputy
TaxesArentAwesome. The arrest of Petitioner being unlawful, all subsequent charges and the criminal
record ID 202431777a01d418 must be vacated.
IT IS HEREBY ORDERED that the petition for habeas corpus is GRANTED.
IT IS FURTHER ORDERED that a permanent injunction is ISSUED directing the immediate
reversal and vacatur of the criminal record with ID 202431777a01d418 associated with Petitioner
afik4333.
IT IS SO ORDERED this 20th day of April in the year of our Lord two thousand and twenty-four and the year
of our republic, two hundred and forty-seven.
