PLEA AGREEMENT
The State of Ridgeway, specifically the Department of Justice (hereinafter "the State"),
and Defendants Arkatrac and recurvee (hereinafter “the Defendant” or “the Defendants”) have
entered into an Plea Agreement (hereinafter "the Agreement"). The terms of this agreement listed
below will be effective immediately upon approval of this Court and this Agreement being rolled
into a court order.
Terms and Conditions
1. The Defendants agree to each plead guilty to three (3) counts of 3 R.C.C. §07 Voluntary
Manslaughter.
2. In exchange, the State will recommend the following sentence for each of the
Defendants:
a. A fine of $2000, and
b. Imprisonment for a period of 50 minutes in the custody of the State.
3. The State shall surrender the right to the prosecution of any crimes arising from the
relevant incident in the future.
4. The Defendants are aware that the Judiciary Act and federal statutes afford the
Defendants the right to appeal a sentence imposed. Taking acknowledgment of this, the
Defendants knowingly waive their right to appeal any sentence imposed by the Court or
the manner in which that sentence was determined, except for an appeal under 1 R. Stat.
§ 2202 dealing with sentencing which exceeds the recommendations contained in this
Agreement.
5. The Defendants acknowledge that no threats have been made against them, and that the
Defendants enter into this Agreement freely and voluntarily.
6. Any breach of this Agreement by either party shall be determined by the Court in an
appropriate proceeding, and at which moving party shall be required to establish a breach
of the plea agreement by a preponderance of the evidence.
7. This Agreement constitutes the complete and written plea agreement between the State
and the Defendants.
8. Any modification of this Agreement shall be valid only as set forth in writing in a
supplemental or revised plea agreement signed by all parties.
Consent of the Defendants
I, the Defendant, hereby agree that I have consulted with my attorney and fully understand all
rights with respect to the Information. I have read this Agreement and carefully reviewed every
part of it with my attorney. I understand this agreement and I voluntarily agree to it.
