PLEA AGREEMENT

PLEA AGREEMENT
The State of Ridgeway, specifically the Department of Justice (hereinafter referred
to as “the State”), and Defendant have entered into a Plea Deal (hereinafter “the
Agreement”). The terms of this agreement listed below will be effective immediately
upon approval of this court and this Agreement being rolled into a court order.
TERMS AND CONDITIONS
1. The Defendant hereby agrees to enter a plea of GUILTY to all charges within the
Criminal Information filed herein. In exchange, the Department of Justice
Criminal Division will recommend to the Court a total of $4000 fine payable to
the court within the next 7 days.
2. The Defendant is fully aware that any term of supervised release, possibly to serve
out a community service requirement agreed herein, is in addition to any prison
term that the Defendant may receive, and that any instance of violation of a term
of supervised release could result in extenuating punishments for the Defendant
pursuant to the Judiciary Act of 2022.
3. The Defendant is aware that the Judiciary Act and federal statutes affords the
Defendant the right to appeal a sentence imposed. Taking acknowledgement of
this, the Defendant knowingly waives his right to appeal any sentence imposed by
the Court, or the manner in which that sentence was determined, on the grounds
specified in law, or on any grounds whatsoever, in exchange for the concessions
made by the Department of Justice in this agreement. This agreement, however,
does not affect the rights or obligations of the State.
4. The State will not further criminally prosecute the defendant for the specific
conduct described in the Criminal Information/Indictment.
5. The Defendant agrees that they are satisfied that their attorney(s) have rendered
effective assistance of counsel. The Defendant understands, that by entering into
this agreement, that they surrender certain rights as provided in this Agreement.
6. The Defendant hereby waives their right to a jury trial, the right to question
witnesses; the right to impeach the credibility of the State’s case; and other rights
the Defendant would have at trial.
7. The Defendant agrees to cooperate fully, truthfully, and completely with the State,
and provide all Information known to the Defendant. If the Defendant fails to
cooperate, this Agreement shall be null and void, and the matter brought back into
the docket of this Court.
8. The Defendant, while this agreement is in effect, shall not commit any other
crimes, or this Agreement shall be null and void, and the matter brought back into
the docket of this Court.
9. Any breach of this Agreement by either party shall be determined by the Court, in
an appropriate proceeding, and at which moving party shall be required to
establish a breach of the plea agreement by a preponderance of the evidence.
10. This Agreement constitutes the complete, and written plea agreement between the
State and the Defendant.
11. The Defendant acknowledges that no threats have been made against them, and
that the Defendant enters into this Agreement freely and voluntarily.
12. Any modification of this Agreement shall be valid only as set forth in writing in a
supplemental or revised plea agreement signed by all parties.
13. Defendant’s consent shall be given in writing and attached in an appendix below.
DEFENDANT’S STATEMENT
I, the Defendant, hereby agree that I have consulted with my attorney and fully
understand all rights with respect to the Information. I have read this Agreement and
carefully reviewed every part of it with my attorney. I understand this agreement and I
voluntarily agree to it.

CONSENT OF THE STATE
The State, having gained the permissions as necessary by law and policy, does
hereunto enter into an agreement with the Defendant and pledges to fulfill the obligations
guaranteed through this Agreement. The signatories here declare that all submissions are
made in good faith to the Court and to all intensive purposes this shall serve as a de facto
good faith certificate concurrently as an Agreement.
