CERTIFICATION ORDER
In accordance with Rule 22, uniform certification on questions of law:
Question of law to be answered: Can magistrate judges be appointed to hear civil
cases against the government?
In the present matter against the government, a magistrate was appointed to conduct
pretrial proceedings. Counsel for the intervener pointed out that magistrate judges may
not be eligible to conduct said proceedings.
Section 2.1(e) of the Judiciary Act provides that: “A superior court judge may appoint
a magistrate to hear any case, so long that the superior court judge reviews the trial
record and approves all judgments related to the case. This shall not extend to cases
involving indictment against a public official or civil cases against the Government.”
The pronoun “this” in the second sentence is without antecedent. It is unclear what
“this” and by extension the operative clause “shall not extend to” are referring to.
