AFFIDAVIT FROM THE RESPONDENT REGARDING THE WRIT OF HABEAS CORPUS
This affidavit shall serve as the “affidavit supporting [an] arrest signed by the respondent” as required by
the Ridgeway Judiciary Act (2022)(2.5)(b)(v)(1); see also 1 R. Stat. § 2211 (v)(a).
I, iiSandwich_Lawz, swear under the pains and penalties of perjury that the statement and
additional information provided in this affidavit is true.
At the time of the arrest, I was on duty and fulfilling my duties as a Sergeant in the Palmer
Police Department. I was running a checkpoint at the Palmer Tunnel when the plaintiff
approached, driving a blue Tremor Cobral, I had already dealt with the plaintiff during an
interaction prior to this. The plaintiff proceeded to drive up onto the concrete barriers on the
side of the road in order to attempt to bypass the checkpoint, as they had done previously. I
ignored this and one of the officers under my command told me I should arrest the plaintiff for
reckless driving. I removed the plaintiff from their vehicle and placed them into handcuffs,
informing them of their arrest for reckless driving. After reviewing the Ridgeway State
Database, I realised that the plaintiff’s actions did not constitute reckless driving. I then cited
the plaintiff for failing to maintain lanes, at which point I released the plaintiff from handcuffs
and allowed them to go back to their vehicle.
The plaintiff then drove back up to the checkpoint, at which point I requested their username
for identification purposes. After I asked the plaintiff numerous times to no avail, I removed the
plaintiff from their vehicle and placed them under arrest for § 2.05, Failure to Identify.
