COMPLAINT FOR DAMAGES
Hitherwguys, proceeding with counsel hereby brings this civil action and for their allegations
against the Defendant, it is alleged as follows:
INTRODUCTION
1. On February 8th, 2024, Plaintiff Hitherwguys was in the vicinity of Bloxmart and
thereafter was observed driving by parking garage where a group of law enforcement
officers, specifically state troopers and sheriff deputies, were conducting a traffic stop.
This traffic stop was effectively blocking all lanes of traffic, leading to a situation where
the Plaintiff's vehicle approached the area.
2. Upon nearing the scene, Plaintiff Hitherwguys was approached by Deputy
Doggythesnoop, who provided the instruction to "just turn." It remains unclear whether
this instruction was meant to direct the Plaintiff to turn away from the scene or to
maneuver the vehicle in a specific manner to facilitate the ongoing law enforcement
activity.
3. Subsequently, Plaintiff was approached by the Defendant, identified as theburnerphone,
who then proceeded to remove the Plaintiff from their vehicle and place them in cuffs.
Defendant then proceeded to search plaintiffs vehicle. During this interaction, another
law enforcement officer, Deputy Sul_z, instructed the Plaintiff to "Keep driving." This
conflicting directive created a situation of confusion for the Plaintiff.
4. Following these interactions, the Defendant transported Plaintiff Hitherwguys to the
Palmer Police Department. Upon arrival and during the time at the police department, the
Defendant refused to respond to the Plaintiff's inquiries and proceeded to charge the
Plaintiff for "Driving Wrong Way".
5. Accordingly, Plaintiff alleges as follows:
JURISDICTION AND VENUE
6. This court has jurisdiction over this matter consistent with Art. V, Sec. IV of the State
Constitution.
7. Venue is proper in this Court because the alleged actions took place in the City of Palmer,
which is an In-game subject to the laws of Ridgeway County.
PARTIES
8. Hitherwguys is a citizen of the State of Ridgeway.
9. theburnerphone is a sworn trooper and citizen of the State of Ridgeway.
FACTUAL ALLEGATIONS
I. The Incident
10. On February 8, 2024, Plaintiff Hitherwguys was present near the Bloxmart location at
approximately 4:44 PM CST.
11. At that time, the Plaintiff was driving their vehicle towards a group of stopped troopers
and sheriff deputies who were conducting a traffic stop that blocked all traffic lanes.
12. While attempting to navigate through the area, Plaintiff was approached by Deputy
Doggythesnoop and given the instruction to "just turn," without further clarification.
13. Almost immediately thereafter, Plaintiff was approached by Defendant theburnerphone,
who physically removed the Plaintiff from their vehicle against their will and without any
legal basis for such action. Defendant then proceeded to search the Plaintiffs vehicle.
14. Concurrently, Deputy Sul_z issued a contradictory command to the Plaintiff to "Keep
driving," which added to the confusion and did not clarify the expected behavior from the
Plaintiff.
15. Subsequently, Defendant theburnerphone transported Plaintiff to the Palmer Police
Department, where the Defendant charged the Plaintiff with "Driving Wrong Way"
without adequate communication or explanation for the arrest and charges.
COUNT 1
1 R. Stat. § 3104 False Imprisonment
16. As defined by 1 R. Stat. § 3104, it is deemed an act of false imprisonment when an
individual, lacking lawful authority or valid justification, impedes another person’s
freedom to move or confines them without their consent, making the transgressor subject
to punitive damages of up to $3,500.
17. The Defendant, known as theburnerphone, on the date in question, did knowingly and
without any legal grounds, restrict the Plaintiff's freedom by compelling their exit from a
vehicle and by effecting their subsequent retention at the Palmer Police Department, a
clear instance of false imprisonment.
a. In light of this conduct, Defendant theburnerphone is culpable under the charge of
False Imprisonment and should bear the statutory punitive damages.
COUNT II
1 R. Stat. § 3114 Official Misconduct
18. As stipulated by 1 R. Stat. § 3114, a public servant is culpable of official misconduct
when they engage in or abstain from an act related to their official duties knowing that
such conduct is unauthorized or when they neglect a legally imposed duty inherent to
their office.
19. The Defendant, theburnerphone, in their official capacity, engaged in unauthorized
detainment of the Plaintiff, and exhibited a dereliction of mandated duties, amounting to
official misconduct.
a. The Plaintiff experienced harm due to this wrongdoing enduring detention and the
resulting emotional distress.
b. As a result of the Defendants actions they are liable for compensatory damages,
injunctive relief, and punitive damages as prescribed by the law.
RELIEF
WHEREFORE, Plaintiff prays that the Court grant relief as follows:
A. Enter judgment against the defendant on all counts.
B. 1 R. Stat. § 3104 False Imprisonment - The Plaintiff asks the court to impose
$3500 in punitive damages on Defendant theburnerphone and expunction of their
“Driving Wrong Way” record for the false imprisonment endured by the Plaintiff
for violating.
C. 1 R. Stat. § 3114 Official Misconduct - The Plaintiff is asking the court to grant
compensation for damages amounting to $2500 in punitive damages in
compensatory damages against the Defendant, theburnerphone for violating..
D. That this court grant any other relief deemed appropriate.
