DISCOVERY RULING
The governments moved to compel the accused Mayollid to produce his recent direct
messages with rapcreeper22. The government has failed to demonstrate with any
reasonable particularity the contents of those messages or conclusively demonstrate
any knowledge of the compelled facts. It is not sufficient for the government to merely
demonstrate that it knows that certain messages exist—it could probably say the same
for every case. The facts are anything but foregone, perhaps except for the fact that the
government is trying to recruit the court to use its subpoena powers to abet the
government in their fishing expedition.
I determine that the foregone conclusion doctrine does not apply to Mayollid’s direct
messages to rapcreeper22. Motion denied.
