SUPERIOR COURT OF THE STATE OF RIDGEWAY FALCON_2S, Plaintiff, v. ORBXS; GGUTSLASHER; HAUNNTINGS, Defendants. No. RSC-CV-2264 FIRST AMENDED COMPLAINT Plaintiff falcon_2s, by and through undersigned counsel, hereby brings this civil action against Defendants Orbxs, ggutslasher, and Haunntings and alleges that– INTRODUCTION 1. On or about February 23, 2024 at 5:16 PM Mountain Time, Plaintiff falcon_2s was driving down Palmer Boulevard in Downtown Palmer in his white Actilla Sport vehicle. 2. He stopped his white Actilla Sport vehicle at a traffic light displaying a steady red signal at Palmer Boulevard and Laguna Avenue in front of the Palmer Police Department (PPD). 3. After stopping, Defendant ggutslasher shot through Plaintiff falcon_2s’ windshield and killed Plaintiff falcon_2s in short time. 4. Then, Defendants ggutslasher and Haunntings shot at Plaintiff falcon_2s’ white Actilla Sport vehicle. 5. Defendant Orbsx joined in the shooting and contributed to Defendants ggutslasher and Haunntings’ shooting at Plaintiff falcon_2s’ white Actilla Sport vehicle. 6. After Defendants ggutslasher, Haunntings, and Orbxs shot at and caused Plaintiff falcon_2s’ white Actilla Sport vehicle to be on fire, they all fled in a grey Actilla vehicle. JURISDICTION AND VENUE 7. This Court has jurisdiction pursuant to Article V, Section IV of the Constitution of the State of Ridgeway. 8. Venue is proper in this Court because the events described in this Complaint took place within Ridgeway County. PARTIES 9. Plaintiff falcon_2s is a resident of the State of Ridgeway. 10. Defendant Orbxs is a resident of the State of Ridgeway. 11. Defendant ggutslasher is a resident of the State of Ridgeway. 12. FIRST CAUSE OF ACTION (Wrongful Death) (As to Defendant ggutslasher) 13. Plaintiff repeats and realleges the allegations contained in all preceding paragraphs as if fully set forth herein. 14. Defendant ggutslasher shot through the windshield of Plaintiff falcon_2s’ white Actilla Sports vehicle and fatally wounded Plaintiff falcon_2s without legal cause or justification, and wrongfully caused Plaintiff’s death. SECOND CAUSE OF ACTION (Trespass to Chattels) (As to All Defendants) 15. Plaintiff repeats and realleges the allegations contained in all preceding paragraphs as if fully set forth herein. 16. Defendants Orbsx, ggutslasher, and Haunntings jointly and severally destroyed Plaintiff’s white Actilla sports car by shooting at it with firearms and interfered with Plaintiff’s ownership, possession, and usage of said sports car by destroying it, depriving Plaintiff of its use. PRAYER FOR RELIEF Wherefore, Plaintiff prays that the Court– a. Declare that ggutslasher wrongfully killed falcon_2s; b. Declare that Orbsx, ggutslasher, and Haunntings jointly and severally destroyed falcon_2s’ white Actilla Sports vehicle; c. Award Plaintiff actual damages; d. Award Plaintiff punitive damages; e. Award such other, further, or different relief as may be just and proper. Respectfully submitted.
