STATEMENT OF FACTS
1. Petitioner, SUPRAMQRK5, is a Lieutenant in the Palmer Police Department,
subject to the policies and regulations set forth by the department.
SUPRAMQRK5 has had no prior disciplinary history throughout his career in the
department.
2. Pursuant to 2 R. Stat. § 3102, all departments, including the Palmer Police
Department, are obligated to publish clear and unambiguous codes of conduct
explicitly prescribing the degree of punitive action for each offense. This statute
aims to prevent individuals from being held accountable for ambiguous offenses
without defined punitive measures.
3. Petitioner was suspended by the Palmer Police Department for an alleged breach
of the “professionalism policy.” However, there is no "professionalism policy”
within the Palmer Police Department’s published code of conduct.
4. The Internal Affairs Division referred to a specific section of the Standard
Operating Procedure (SOP) that states the “professionalism policy.” However,
there is no "violation of SOP" section within the Code of Conduct that adequately
addresses the alleged offense.
5. The Palmer Police Department's Code of Conduct does not include all offenses
listed in the Standard Operating Procedures, resulting in a deficient set of
regulations that fails to provide clear guidelines for punitive actions associated
with each offense.
6. The Palmer Police Department additionally charged SUPRAMQRK5 with a
“jurisdiction violation,” an offense that is cited in the Code of Conduct.
7. The Code of Conduct prescribed the appropriate punishment for a “jurisdiction
violation” on the first offense is a warning. However, the petitioner was suspended
from his position instead.
ARGUMENT
1. SUPRAMQRK5 has displayed a consistent adherence to the policies and
regulations set forth by the Palmer Police Department, and has been recognized
for his performance.
2. The Internal Affairs Division grossly disregarded the statutorily-mandated code of
conduct and has unlawfully removed and imposed sanctions on SUPRAMQRK5.
DEMAND FOR REMEDY
The Petitioner prays for the following relief:
1. Immediate reversal of the Suspension and Imposition of a “Zero Tolerance” Period
imposed by the Palmer Police Department
