Affidavit In Support of Plaintiff’s
Motion for Default Judgment
AFFIDAVIT IN SUPPORT
I, ATLANTXIC, being duly sworn, hereby depose and state as follows:
1. My name is ATLANTXIC and I am a Resident of the State of Ridgeway of which
this Court has competent jurisdiction over. I am the Plaintiff to the aforementioned
matter, and I have personal knowledge of the facts and circumstances related to this
affidavit.
2. This affidavit is being filed in support of the attached Motion for Default
Judgment submitted on February 3rd, 2024.
3. Defendant SUPERKURD56 was served by publication pursuant to leave granted
by the Court for alternative service under Rid. R. Civ. P. 4(a). Publication was made on
January 26th, 2024.
4. Despite service by publication, Defendant SUPERKURD56 has not appeared
before the Court, entered answer to the Complaint in this matter, or made any attempt to
reconcile with me.
5. I filed this suit to recover damages resulting from the actions of the Defendant
related to an assault and attack against me that severely damaged my personal property in
a manner that rendered it unusable.
6. The computation of costs of all damages sustained as a result of this incident are
listed as follows and are computed based on real market value:
i. Damaged Blue Tremor Vehicle : $600
ii. Cline 911 Firearm : $235
iii. 9mm Ammunition : $33
7. The computation of costs of all other monetary expenditures sustained as a result
of litigating this matter are listed as follows:
i. Attorney’s Fees : $1,000
ii. Court Filing Costs : $125
8. Therefore, I request that the Court direct the Clerk to enter the default of
Defendant SUPERKURD56 and issue judgment against them in the amount of $1,993 for
compensatory damages, as well as $4,500 in full punitive damages. The total judgment
would amount to $6,493.
