DOCKET NUM. RSC-CV-2186
Plaintiff,
v.
CODKING2318
Defendant.
I. DEFENDANT’S MOTION TO DISMISS FOR FAILURE TO BRING A CLAIM WITHIN THE
STATUTE OF LIMITATIONS PRESCRIBED TIME FRAME
1. Arthur_Chen (“Plaintiff”, “Officer Chen”, “Arthur”) alleges in his complaint that this
incident took place “On or about the first day of October, two thousand and twenty-four,
at approximately 23:02 Eastern Standard Time[.]”
2. All places around the world have entered the new year, two thousand and twenty-four
(“2024”). With that new year, the entire world restarts the months. Currently, it is January
and the Plaintiff alleges the incident to have happened in October. It is only reasonable
that this court assume the Plaintiff intended to allege two thousand and twenty-three
(“2023”) as the year the incident took place because that is simply the most recent
October.
3. No civil complaint, unless explicitly permitted by law for a longer period of time, shall
be accepted after (60) days of the listed date of occurrence of the action causing the
dispute as codified under 1 R. Stat. § 2406.
4. Due to this claim alleging an incident 121 days ago and filing a complaint 115 days after
the alleged incident, this claim falls in violation of 1 R. Stat. § 2406.
See next page . .
II. CONCLUSION
Conclusively, the court should dismiss this claim as it can no longer be brought under
1 R. Stat. § 2406 and should dismiss this matter with prejudice for that very reason.
Respectfully submitted,
Derogatoryyy
