SENTENCING ORDER
Mr. CardinalMonterruh:
Your sentence is as follows:
• As to count 1, second-degree murder (lesser included) – 100 minutes
imprisonment.
• As to count 2, aggravated assault class II – 75 minutes imprisonment.
• As to count 3, unlawful display of a firearm – 25 minutes imprisonment.
• As to count 4, disorderly conduct – 25 minutes imprisonment.
I order that each of the terms of imprisonment be served concurrently to each other.
I further order that you are prohibited from acquiring and possessing a firearm of any
class for a period of 90 days following the date this order is entered. Upon entry of this
order, your license or any document issued in any jurisdiction that allows you to acquire
or possess a firearm is revoked and must be surrendered.
I further order that the convictions for second-degree murder and aggravated assault
class II may not be set aside for a period of 6 months following the date this order is
entered. Nor may said convictions be set aside except on application for a class 3
expungement, provided that you meet the statutory requirements for a class 3
expungement.
I further order that the convictions for unlawful display of a firearm and disorderly
conduct may not be set aside for a period of 3 months following the date this order is
entered. Nor may said convictions be set aside except on application for a class 3
expungement, provided that you meet the statutory requirements for a class 3
expungement.
