ORAL REASONS FOR JUDGEMENT
First, the Information contains the time and location of when and where each offence
charged is alleged to have occurred. The Information is not ambiguous or unclear.
Second, multiple counts for multiple unlawful possessions that happened at the same
time is proper. In principle, I refer to State of Ridgeway v. kaikjs (RSC-CM-531) where
a grand jury found probable cause to indict the accused on 19 individual counts of both
unauthorized distribution of police-grade equipment and official misconduct where
each count occurred at the same time. At this preliminary stage in the present case, I
find no possibility of double jeopardy arising from these charges in the Information
against the accused. For these reasons, the Information will stand and the motion to
dismiss is denied.
Pretrial orders: disclosures must be certified by April 15, 2023.
