REPORT AND RECOMMENDATIONS
IN THE MATTER OF AN APPLICATION
UNDER SECTION 1.3 OF THE ADMINISTRATIVE PROCEDURE ACT
I. Introduction
[1] Chief Ranger xXBoomblast339Xx applied for an administrative hearing under s.
1.3 of the Administrative Procedure Act on February 8th, 2023.
[2] The application named IBoughtYouMyBuIIets, an employee of the Ridgeway
Parks Service as the respondent.
[3] The application sought to dishonourably discharge IBoughtYouMyBuIIets for
numerous violations of departmental policy, such as the conduct policy, general
standards policy, in-game standards policy, and the departmental vehicle search &
seizure policy.
[4] Applicant xXBoomblast339Xx filed a brief under s. 3.1 of the Employee
Desertion Act in support of an expedited ruling in the absence of the respondent.
[5] I am satisfied that the respondent has deserted their duties, failed to respond to the
applicant’s communications, and failed to respond to the notices to appear before the
administrative court. Accordingly, I will omit the hearing.
[6] All factual allegations are assumed as true, having gone uncontested by the
respondent, and are reproduced in Part II.
II. Findings of Fact
[7] On January 20th, 2023, it was reported to the Ridgeway Park Service Internal
Affairs Unit that Volunteer Park Ranger IBroughtYouMyBuIIets had violated
numerous laws off-duty and went onto the RPS team to avoid peace officers.
[8] On January 20th, 2023, Volunteer Park Ranger IBroughtYouMyBuIIets was
subsequently placed on Administrative Leave and an investigation was launched.
[9] On January 20th, 2023, Senior Park Ranger Arventize began the investigation and
sustained the summary disposition of the investigation.
[10] On January 31st, 2023, Senior Park Ranger Arventize completed the investigation
and sustained the following violations on the Final Disposition:
[a] Violation of Handbook “Conduct Policy”
[b] Violation of Handbook “General Standards Policy”
[c] Violation of Handbook “In-Game Standards Policy”
[11] It was recommended by the Internal Affairs Unit that Volunteer Park Ranger
IBroughtYouMyBuIIets be generally discharged from the Ridgeway Park Service.
[12] After multiple attempts from RPS IA rangers to organise a discharge search,
IBroughtYouMyBuIIets failed to respond and refused to complete a department
search.
[13] For refusing department search, the disposition was amended to a dishonourable
discharge and Violation of Handbook “Departmental Vehicle and Seizure Policy” was
added.
[14] The recommendation was approved by Assistant Superintendent
ConstantlyVerbal and an Administrative Hearing Report was filed.
III. Findings of Law and Policy
[15] It is a contravention of Ridgeway Parks Service policies for an employee to
terminate their employment without allowing the employer to search their inventory
for agency property.
[16] The respondent had violated the conduct policy of the Ridgeway Park Service
Handbook when he engaged in misconduct while being on duty as a member of the
Parks Service, subjecting him to administrative action.
[17].The respondent had failed to abide by the general standards policy when he
engaged in multiple illicit activities while off duty, prior to joining the parks service
team to evade law enforcement.
[18] The respondent has engaged in misconduct pursuant to the in-game standards
policy by misrepresenting the Ridgeway Park Service, by acting in an unprofessional
manner.
[19] The respondent had violated the departmental vehicle and seizure policy with his
failure to respond to the discharge request by members of the Ridgeway Parks Service.
[20] Respondent IBoughtYouMyBuIIets is subject to the Ridgeway Parks Service
Handbook.
[21] I find that the acts of engaging in illegal actions, attempting to evade law
enforcement through use of the Ridgeway Parks Service team, and subsequently
refusing to respond to requests for a departmental search were intentional and done
with ill intent.
IV. Recommendations
[22] The applicant recommends termination of the respondent’s employment in the
Ridgeway Parks Service in the nature of a dishonourable discharge.
[23] The applicant is entitled to take any action up to and including a dishonourable
discharge.
