REPORT AND RECOMMENDATIONS
IN THE MATTER OF AN APPLICATION
UNDER SECTION 1.3 OF THE ADMINISTRATIVE PROCEDURE ACT
I. Introduction
[1] Captain iiDark_Law applied for an administrative hearing under s. 1.3 of the
Administrative Procedure Act on January 30, 2023.
[2] The application named tankseb, an employee of the Palmer Police Department
as the respondent.
[3] The application sought to dishonourably discharge tankseb for one violation of
department policy enumerated at s. 502.1 of Palmer Police Department Standard
Operating Procedures.
[4] Applicant Da_BeastlyMan filed a brief under s. 3.1 of the Employee Desertion
Act in support of an expedited ruling in the absence of the respondent.
[5] I am satisfied that the respondent has deserted their duties, failed to respond to
the applicant’s communications, and failed to respond to the notices to appear before
the administrative court. Accordingly, I will omit the hearing.
[6] All factual allegations are assumed as true, having gone uncontested by the
respondent, and are reproduced in Part II.
II. Findings of Fact
[7] The Palmer Police Department requires an officer who plans on resigning or
transferring to serve at least 14 days in the department and requires to give formal
notice to a captain+ or they may be subject to a dishonorable discharge.
[8] Officer tankseb has left all ridgeway-related servers.
[9] The officer did not contact a captain.
III. Findings of Law and Policy
[10] It is a contravention of Palmer Police Department policies to resign or transfer
without giving proper formal notice.
[11] The respondent contravened s. 502.1 of Palmer Police Department Standard
Operating Procedures when he failed to give proper formal notice before leaving post.
[12] Respondent tankseb is subject to the Palmer Police Department Standard
Operating Procedures.
[13] I find that the act of leaving a Discord server or Roblox group was intentional.
IV. Recommendations
[14] The applicant recommends termination of the respondent’s employment in the
Palmer Police Department in the nature of a dishonourable discharge.
[15] The applicant is entitled to take any action up to and including a dishonourable
discharge.
