SENTENCING ORDER
The government filed a pre-sentence report which concluded that Proceed101 is a high-
risk re-offender and offered its recommendation for sentencing and proposed terms of
probation. The accused waived the filing of a pre-sentence report. Seeing no contest to
the government’s sentencing submissions, I accept the same and impose the sentence
as follows.
• The sentence for count 1 is a term of imprisonment for 90 minutes and a term
of probation for 60 days.
• The sentence for count 2 is a term of imprisonment for 60 minutes and a term
of probation for 45 days.
• Each term of imprisonment will run consecutive to each other. Each term of
probation will run consecutive to each other.

PROBATION ORDER
This order supplements the sentencing order of May 1, 2023. Starting from the day
Proceed101 is released from imprisonment, he is bound by and must comply with the
terms of probation as described below for the 105 calendar days that follow his release.
Proceed101:
• Must keep the peace and be of good behaviour (inherent jurisdiction).
• Must appear before the court when required to do so by the court (inherent
jurisdiction).
• Must report to a probation officer at least once every 5 days (Judiciary Act s.
3.2(c)).
• Is subject to, if arrested on any charge, 1.5 times the normal jail time (Judiciary
Act s. 3.2(e)).
• Must notify the court or a probation officer appointed by the Sheriff in advance
of any change of name or address (inherent jurisdiction).
• Is prohibited from acquiring, possessing, or applying for a firearm license or
automatic firearms license (Judiciary Act s. 3.2(f)).
• Must not carry, possess, or discharge a firearm (Judiciary Act s. 3.2(f)).
• Must not carry or possess any blunt or sharp object (Judiciary Act s. 3.2(f)).
• Is subject to random searches, upon reasonable suspicion and without a warrant,
of his home, vehicles, and person (Judiciary Act s. 3.2(h)).
• Must, if asked to do so by any peace officer, identify himself (Judiciary Act s.
3.2(f)).
Proceed101 is ordered to surrender himself to any peace officer in the State of
Ridgeway forthwith. Any peace officer who observes Proceed101 in violation of any
of these terms is authorised to arrest and charge Proceed101 with failure to report to a
probation officer.
