I. Reasons for Judgement
[1] The cause of action created under s. 2.8 of the Administrative Procedure Act
(the Act) does not apply to individual, non-systematic violations of statutory procedure
for hiring practices.
[2] The Complaint makes an allegation of a violation of the Act that is individual
and non-systematic:
“The [agency] denied the Plaintiff as a result of their application of the wrong
criteria, standards, and procedures for background checks.”
[3] Whereas no allegation of systematic violations of the Act was made in the
Complaint, the court has no jurisdiction to hear the associated claims.
[4] The first cause of action is dismissed.
II. Amendment to Summons
[5] Defendants are directed to make answer to the Complaint limited to the second
cause of action only.
