1. Plaintiff admits that firefighters are subject to various conditions when responding to calls
or alerts of fires, or other services in which the RCFD responds to.
2. Plaintiff admits that Truck 28 responded to the Residential fire at the three-storey Palmer
apartments.
3. It is admitted that Plaintiff was on-scene when Truck 28 responded to the Residential fire,
since Plaintiff resides at the Palmer apartments.
4. Denied.
5. It is admitted that Plaintiff filed a lawsuit against Firefighter Dino_Raf for spreading false
information to law enforcement which led to his detainment.
6. Denied.
7. Admitted that the criminal code does state that “Any individual who abuses a legal
process such as a court proceeding... by means of providing vexatious, fraudulent or
frivolous complaints to get another in trouble shall be liable.”
8. Denied.
COUNTERCLAIM TWO
1. Denied.
2. It is admitted that the Plaintiff did state within his civil complaint that Firefighter
Dino_Raf did indeed lie to a law enforcement officer.
3. Denied.

5. It is admitted that 1. R. Stat. § 3108 states, “Any individual who intentionally deceives
another party to secure unfair or unlawful gain, or to deprive a victim of a legal right shall
be fraud.”
6. Denied.
