JUDGEMENT AND ORDER
v.
KAFKADELREY.
MEMORANDUM IN SUPPORT OF JUDGEMENT
The case arises following a petition for habeas corpus filed by the plaintiff against the
arresting officer in a traffic stop and pursuit. The plaintiff was a passenger in a fleeing vehicle
which only ended following the car being flipped over. The arresting officer detained and later
arrested the plaintiff for the same offences as expected of his ‘accomplice’.
While I would have liked to have analysed this further I am unable to do so because the
State representing the defendant in his official capacity has refused to contest the petition for
habeas corpus and therefore I am directed under law to accept and expunge the records. See 1 R.
Stat. § 2211.
Therefore the court GRANTS the petition for habeas corpus and EXPUNGES the records
of the plaintiff-petitioner relating to the incident above.
