Comes now, the Plaintiff, epidermisupta69, by and through the undersigned counsel filing
this motion for default judgment—
ARGUMENT
The Ridgeway Rules of Civil Procedure plainly provide that any person has five days to
respond to pleadings after summons. Rid. R. Civ. P 5(e). Defendant waived summons on the 2nd
of January, 2023, at 14:01 CST. Therefore, the Defendant would have until the 7th of January,
2023, at 14:01 CST to respond to the civil complaint. The Defendant has failed to file a response
until the 9th of January, 2023, 22:10 CST; the Defendant has therefore defaulted.
In accordance with Rid. R. Civ. P 37, when a party has “failed to plead” this Court shall
“enter his default.” Defendant has failed to properly file a pleading disputing the facts within the
required time frame, and therefore ought to be held in default. This Court did the same in the cas
of xjvmma v. PirateHookTail, RSC-CV-834 (2023). In that case the Defendant also failed to plead
his defense and was held in default. The same should occur here.
