STATE OF RIDGEWAY SUPERIOR COURT HITHERWGUYS, -against- FOULWRAITH, Defendant. DOCKET NO. RSC-CV-838 SETTLEMENT AGREEMENT On this 1st day of January 2023, a legally binding agreement by and between Mr. Hitherwguys (“Plaintiff”) and Mr. FoulWraith (“Defendant”) is filed. 1. Definitions: the following definitions shall apply when used in this contract: a. “Immediate availability”, when used in this contract, will mean when both parties are available to join the game for the period of time necessary for the money to be transferred. 2. Agreements: the parties, upon agreement of this document, legally agree on the following terms and conditions: a. Mr. Hitherwguys agrees to discontinue all legal proceedings against Mr. FoulWraith for their actions on or around December 31st, 2022, which gave rise to the proceeding Hitherwguys v. FoulWraith, RSC-CV-838 (2022). b. Mr. Hitherwguys agrees that he will no longer pursue any additional administrative actions, legal proceedings, or any other mechanism of recourse for any injury allegedly sustained on December 31st, 2022 as a result of the actions of Mr. FoulWraith and related to the proceedings herein. c. Mr. FoulWraith agrees to not pursue any counterclaims or other related filings pertaining to the case Hitherwguys v. FoulWraith and the events at the issue therein. d. Mr. FoulWraith will pay Mr. Hitherwguys $500 dollars in-game at both parties’ immediate availability. 3. Termination of Agreement a. If any party is found to have violated any clause, sentence, or agreement within this settlement they agree they are liable for civil damages in civil court for violation of this contract. b. In the event that any party violates a provision of this agreement, the other party shall have the right to continue to pursue legal damages for the events of December 31st, 2022 as alleged by the pleadings in the original case stated herein.
